The role of intellectual property rights (IPRs) has been extensively debated in the literature on technology transfers and agricultural production in developing countries. However, few studies offer cross-country evidence on how IPRs affect yield growth, for example, by incentivizing private-sector investment in cultivar improvement. We address this knowledge gap by testing technology diffusion patterns for six major crops using a unique dataset for the period 19612010 and an ArellanoBond linear dynamic panel-data estimation approach. Findings indicate that both biological and legal forms of IPRs tend to promote yield gap convergence between developed and developing countries, although effects vary between crops.

One of the alleged benefits of the recent global movement to strengthen intellectual property rights (IPRs) is that such reforms accelerate transfers of technology between countries. Branstetter, Fisman, and Foley examine how technology transfer among U.S. multinational firms changes in response to a series of IPR reforms undertaken by 12 countries over the 1982-99 period. Their analysis of detailed firm-level data reveal that royalty payments for intangibles transferred to affiliates increase at the time of reforms, as do affiliate research and development (R & D) expenditures and total levels of foreign patent applications. Increases in royalty payments and R & D expenditures are more than 20 percent larger among affiliates of parent companies that use U.S. patents more extensively prior to reform and therefore are expected to value IPR reform most. This paper--a product of Trade, Development Research Group--is part of a larger effort in the group to understand the global impact of stronger intellectual property rights.

Over the course of history, different legal instruments for protecting intellectual property have emerged. These instruments differ in their subject matter, extent of protection, and field of application, reflecting society's objective to balance the interests of creators and consumers for different types of intellectual works. These legal instruments are just one of the pieces that form a national system of intellectual property protection. Also crucial to the system's overall effectiveness are the institutions administering these instruments, the mechanisms available for enforcing IPRs, and the rules regarding the treatment of non-nationals. To address some of the issues concerning IPRs, this paper defines what they are and attempts to evaluate the relationship between the protection of intellectual property and economic activity in developing countries. It also summarizes the economic effects of IPRs in terms of creation and diffusion of knowledge and information; and market structure and prices. The contributions in this publication are an outcome of growing concerns around the world about the prevailing inefficiencies in agriculture and agribusiness and the need to improve productivity, profitability, and financial sustainability of agriculture and agribusiness by privatizing state- owned enterprises and eliminating unnecessary government regulations. It is in this context that an international symposium was organized on April 19-30, 1993, to address these policy concerns and thereby to improve the long-term prospects for productive and financially sustainable agriculture and agribusiness development. The policy issues addressed herein were identified in a series of discussions at IFDC and with the authors. The main objectives were to focus on analytical policy issues that accelerate the process of privatization and market deregulation of publicly owned and operated enterprises and to provide necessary operational guidelines for policy reforms. This publication is structured around four main topics: (1) the role of agribusiness in economic development; (2) possible approaches and guidelines for privatization and deregulation of agribusiness; (3)the necessary enabling policy environment for privatization and deregulation; and (4) selected case studies. The views expressed in this publication belong solely to the respective authors and should not be attributed to IFDC, World Bank, or other organizations represented. Readers should keep in mind that when authors refer to `current' or `present' situations, they generally mean 1992/93 unless otherwise specified.
