Both security and human rights are important to all within the civilized world. Yet there are some serious tensions between the two political norms. For instance, it may not be easy for a state or the international community to reconcile well intentioned acts to maintain security and to preserve human rights. In the recent past, such a difficulty has been played out not only in the events, but also in the aftermath of the September 11, 2001 terrorist attacks in the United States. The result of the attacks, culminating in the massive loss of lives and property, has been in the adoption of various international treaties and domestic laws that have swiftly been enacted and deployed to counter terrorism, and the development of a concept of a state of "urgency" that appears to shadow the obligation to protect fundamental human rights, particularly the right to life under international law. This thesis thus focuses on the promotion and protection of fundamental human rights, particularly, the right to life with the subsequent declaration of the "war on terror" by the United States. The work targets the debate between security and human rights in the light of terrorism post 9/11, highlights the impact of choosing one ideal over another, and eventually rationing out a balance that would serve as a threshold for upholding standards in both security and human rights in the face of terrorism threats. Essentially, however, this thesis is hinged on the argument that to allow the ideal of security which apparently appears advantageous to a "continuing state of urgency" to overwhelmingly influence the implementation of counter-terrorism measures while paying no attention to the fundamental right to life would constitute a paradox in combating terrorism. I posit that the result of the above exercise, if chosen, implies more tragic consequences when implemented than the singular acts of terrorism in themselves.

The tragic events of 11 September 2001 have led to an intensification of measures against terrorism both at the level of states and international organisations. New laws and resolutions have been passed in order to strengthen national and international action against terrorism. Some of these measures violate human rights and have been introduced without respect for obligatory procedures under international human rights conventions for derogations in cases of emergency. This development has given rise to much concern worldwide. In order to analyse the many (human rights) questions posed by the intensified struggle against terrorism, a symposium was organised, on the initiative of the Marangopoulos Foundation for Human Rights (MFHR) of Athens, by the European Training and Research Centre for Human Rights and Democracy (ETC) in Graz and the Diplomatic Academy of Vienna together with the MFHR. This volume brings together most of the contributions to this high-level and in-depth discussion in edited, updated form. Among the issues analysed are the dangers entailed in the new doctrine of pre-emptive wars, the issue of the prevention of terrorism through measures addressing its causes and the strengthening of human security. The volume also contains an annex with major documents relating to the question of human rights and terrorism at universal and regional levels prepared by international organisations and NGO's, which represents a useful handbook on the topic. Terrorism has both direct and indirect effects on human rights. As terrorism becomes more widespread and systematic, it has emerged as a significant threat to human rights throughout the world. Terrorism has evolved from the 70's to it modern forms which is more organized, financially stable and coordinated, targeting thousands of civilians who are most times casualties' in cases of kidnappings, murder and sexual abuse; which is a grave violation of human rights. However, despite its real threat to human rights directly, the ways in which it is dealt with by some states and their agencies is critical in ensuring the success of the efforts directed towards anti-terrorism measures. Anti-terrorism measures which do not adhere to the fundamental human rights undermines the efforts in developing effective and practical approaches in countering terrorism. This is because most states have engaged in practices that are directed toward pursuing their interests, thereby violating the same rights that they claim to protect. There is therefore a need for widespread research on the impacts of terrorism on human rights to come up with practical recommendations in protecting these rights through appropriate counter terrorism measures.

In conclusion, the systematic targeting of individuals under the guise of counterterrorism not only disrupts lives but also severely impacts Turkey’s legal and social fabric, questioning the integrity of its commitment to upholding fundamental human rights and freedoms.
