The arrange ment is in the main that of Benjamin. The statement of rules and principles in the black-letter text has to a considerable extent, though with many modifications, necessitated by the difierences between the American and English law, or by other reasons, been taken from the English Sale of Goods Bill, as drafted by his Honor, Judge Chalm ers, and published together with his invaluable notes under the title of The Sale of Goods. This bill, which was purely a codify ing measure, has since been substantially enacted as An act for codifying the law relating to the sale of goods (56 57 Vict. C. 71; February 20, The writer has made frequent use both of the notes of Judge Chalmers and of the text of Benjamin on Sales. The references to Benjamin are to the sections as found in the sixth American edition, of Messrs. Edmund H. And Samuel 0. Bennett. Excerpt from Handbook of the Law of Sale of Goods The Sale of Goods Act, 1893, by which the law relating to the sale of goods was codified in the United Kingdom, has now been adopted, with slight modifications, in all the provinces of Canada except Quebec, the process of adoption having been completed by the enactment in Ontario of the Sale of Goods Act, 1920. Prior to the adoption of the stat ute there existed, especially in Ontario, a considerable body of case law. This case law is of course now authoritative only so far as it is consistent with the statute; but for the most part they are' in accord with each other, and the de cisions furnish useful illustrations of the statute. The arrangement of the statute is followed in the main, but in some respects the scheme of the book has necessitated some change in the order of the statutory provisions. The design of the book is to make the statute more readily avail able and more useful in Canada, and references are given to a relatively large number of recent English and Canadian cases. The alphabetical index is supplemented by an unus ually full table of contents, and the comparative table of section numbers will, it is hoped, enable a reader readily to compare the statute in force in one province with that in force in any other province or in the United Kingdom. Excerpt from The Law of Sales I conceive law to be the aggregation of rules which courts of justice feel themselves more or less obligated to follow in deciding controversies. To some extent these rules are formulated and declared by legislative author ity. Most of them, however, have been evolved by judges themselves. These latter rules are not always easy to formulate; if they were, there would be no need for real text-books. Even the precise utterances of various judges can not always be accepted as rules. I believe that no judge has power, either practically or theoretically, to bind other judges by any declaration of rule or command, but that the only obligation felt by courts is the obligation to con form to prior judicial action. It is therefore prior judi cial conduct under given circumstances which determines the action of later judges, rather than prior declarations as to what such conduct ought to be.
