The 46 Council of Europe member states are encouraged to adapt their legal systems to the specific needs of children, bridging the gap between internationally agreed principles and reality. To that end, the explanatory memorandum offers examples of good practices and proposes solutions to address and remedy legal and practical gaps in justice for children. These guidelines form an integral part of the Council of Europe's strategy on children's rights and its programme "Building a Europe for and with children". A series of promotion, co-operation and monitoring activities are planned in member states in view of ensuring effective implementation of the guidelines for the benefit of all children.

De beginselen van het belang van het kind, zorg en respect, participatie, gelijke behandeling en de rechtsstaat worden met deze richtsnoeren onderstreept en bevorderd. Aan bod komen kwesties als het recht van informatie, vertegenwoordiging en participatie, de bescherming van de persoonlijke levenssfeer, veiligheid, een multidisciplinaire aanpak en opleiding, waarborgen in alle stadia van de procedure en vrijheidsbeneming. De 47 lidstaten van de Raad van Europa worden aangespoord hun nationale rechtsstelsels aan te passen aan de specifieke behoeften van kinderen en de kloof te overbruggen tussen internationaal overeengekomen beginselen en de werkelijkheid. In dit verband worden in de toelichting voorbeelden gegeven van goede praktijken en oplossingen aangereikt voor bepaalde wettelijke en praktische tekortkomingen in justitie voor kinderen. Europarådets 47 medlemsstater uppmanas att anpassa sina rättssystem till barns särskilda behov och överbrygga klyftan mellan internationellt överenskomna principer och verkligheten. Evocam e promovem os princípios do interesse superior da criança, do cuidado e do respeito, da participação, da igualdade de tratamento e do primado do direito. As diretrizes abordam matérias como o direito à informação, à representação e à participação, a proteção da privacidade, a segurança, a abordagem e a formação multidisciplinares, as garantias em todas as fases do processo e a privação de liberdade. Incentiva-se os 47 Estados membros do Conselho da Europa a adaptarem os respetivos sistemas jurídicos às necessidades específicas das crianças, aproximando os princípios internacionalmente acordados e a realidade. Para tal, a exposição de motivos fornece exemplos de boas práticas e propõe soluções para abordar e colmatar as lacunas jurídicas e práticas na justiça de menores. Primjenjuju se na sve okolnosti u kojima je vjerojatno da će djeca biti, po bilo kojoj osnovi i u bilo kojem svojstvu, u kontaktu s kaznenim, građanskim ili upravnim pravosuđem. One podsjećaju na načela najboljih interesa djeteta, skrbi i poštovanja, sudjelovanja, jednakog postupanja i vladavine prava i promiču ih, Smjernice rješavaju pitanja kao što su pravo na obaviještenost, zastupanje i sudjelovanje, zaštita privatnosti, sigurnost, višedisciplinarni pristup i obuka, zaštitna sredstva u svim fazama postupka i lišenje slobode. Četrdeset sedam država članica Vijeća Europe ohrabruju se da prilagode svoje pravne sustave konkretnim potrebama djece, premošćujući jaz između međunarodno dogovorenih načela i stvarnosti. S tim ciljem, obrazloženje nudi primjere dobre prakse i predlaže načine za rješavanje i ispravljanje pravnih i praktičnih praznina u pravosuđu za djecu. Ove su smjernice sastavni dio strategije Vijeća Europe o dječjim pravima i njegovog programa „Izgradnja Europe za djecu i s, djecom“ koji je 2006. godine pokrenuo Monako.
