Edward Shils was one of the giants of sociological theory in the period after World War II. In this autobiography, written three years before his death in 1995, Shils reflects on the remarkable range of his life's work and activities, including founding and editing the journal "Minerva", being a central figure in the Congress of Cultural Freedom, serving as a founding member of the editorial board of "The Bulletin of Atomic Scientists", and being a member of the International Council on the Future of the University. Shils recognizes that a unity of concern runs through his many theoretical writings and activities. Early in his life, the concern was expressed as understanding the character of consensus. During the last fifteen years of his life, he refined his understanding of consensus through investigation of the nature of "collective self-consciousness." That concern was the structure and character of the moral order of a society, and, in particular, liberal, democratic society. Accompanying the autobiography are two unpublished essays, "Society, Collective Self-Consciousness and Collective Self-Consciousnesses" and "Collective Self-Consciousness and Rational Choice," two areas of intellectual concern discussed in the autobiography. This book provides an in-depth study on current perceptions of, and responses to, fragmentation in the European patent system (EPS). For decades, attempts have been made to address this fragmentation by introducing a unitary patent system. The most recent attempt, the EU unitary patent system, will be the first of its kind. It is expected to significantly change the EPS. However, rather than reducing existing fragmentation, it will likely add to it. Based on an analysis of the current and forthcoming system, the book argues that the inherent nature of fragmentation within the EPS needs to be recognised and suggests that a multifaceted approach is required to respond to it. Uniquely, it draws on work regarding fragmentation outside of the patent and intellectual property regimes, gaining insights from both European law-making and the international legal system. These insights are used to investigate current responses to fragmentation in the EPS. Interpretations of substantive patent law are examined, including claim construction (Actavis v Eli Lily), exceptions to patentability related to uses of human embryos for industrial or commercial purposes (WARF, Brüstle, ISCC), and products resulting from essentially biological processes (Broccoli and Tomatoes II, G3/19). Attempts towards convergence in these areas have had mixed results and in some instances fragmentation may be necessary. However, similar techniques to those applied in the international legal system to respond to fragmentation are being used in the EPS, and, where this is seen, it has been to good effect. It is argued that these methods should be recognised, structured, and promoted to make our response to fragmentation more effective. Fragmentation and the European Patent System will be of interest to academics, students and practitioners looking for a new perspective on the EPS.

Few detailed studies that involve complex interactions of social, economic, and technical factors have much direct and immediate impact on the real world. This study could well be one of those few exceptions. Arthur Bernhardt, an internationally known building industry expert, recognized as the leading authority on the mobile home industry, has compiled in this book overwhelming evidence that applying the efficient methods and techniques of that industry to other, older sectors of the building industry will enable the United States and countries around the world to overcome the housing crisis, making it possible to divert some of the expenditures for public subsidization of housing to other social priorities. Far from advocating an endless sprawl of mobile home parks as the basis for tomorrow's housing, Bernhardt states at the outset that "as the housing crisis continues to worsen, many people are asking whether mobile homes might become a viable housing alternative.... My personal answer is 'I hope not!'" Rather, his goal is to transfer the innovative spirit and built-in efficiencies of the mobile home production and delivery system to a full range of housing configurations. Bernhardt reached this conclusion only after overcoming an initial skepticism—he originally shared a widespread negative predisposition toward the mobile home industry: "This basic conclusion is the exact opposite of what I expected to find when I first looked at the mobile home industry years ago. Then, sharing with many others in the United States a strong bias against this industry, I decided to devote a few weeks to writing a negative case study on 'how notto industrialize the building industry.' One of the first findings of this investigation, however, was startling: The mobile home industry is the most efficient building industry in the world." The author then undertook a full-scale study of all aspects of the industry, in a seven-year project at MIT. He built a staff of more than a hundred professionals in such fields as engineering, economics, finance, law, management, political science, and sociology, scattered throughout the country. Supported by the U.S. Department of Housing and Urban Development (HUD), Bernhardt and his staff conducted thousands of surveys and interviews in all sectors of the building industry and at all levels of government. The results of this research were compiled in a massive, five-volume, 5000 page report to HUD. Bernhardt's up-to-the-minute book—which is richly illustrated with halftones and drawings—condenses that report, and sets forth in a vigorous and explicit way the conclusions and recommendations that the full weight of the evidence compels.
