Excerpt from General Grant's Unpublished Correspondence: In the Case of Gen. Fitz-John Porter General Grant, from 1866 to 1876, was successively General-in-Chief, Secretary of War, and President. While holding these positions applications were made to the President by Fitz-John Porter for a rehearing of his case, upon new testimony not attainable during the trial before the court-martial, and which could only be obtained after the war was ended. All of these applications were presented to General Grant. Porter's first appeal was indorsed by ex-Presidents, a judge of the Supreme Court, who had been present at the trial, and by other able jurists. It was also strongly recommended by Senators, Representatives in Congress, Governors, Generals, and other ofificers in the army, and was sustained by undoubted evidence of officers who had been high in command in the Confederate Army and present at the time of the occurrence of the events which were involved in Porters trial. The President favored the appeal, and Acting Secretary of War General Grant, (then general) without whose approval Porter would not have asked for a reopening of the case, so far coincided as to say to Porter that he should return to his home, where, in four days, he would receive the order for a Board, to 7 neet at West Pomt, where all improper mfiuences would have to go and would be discovered. So convinced of the justice of Porters claim was General Grant this soldier then highest in command in the army, and since twice honored with the highest trust in the Nations gift that he said of Porter: Not only ought he to have the rehearing, but every member of the court which sentenced him should be glad to have the opportunity to join in the appeal; and also, if injustice has been done by the finding of the court, resulting in a severe sentence, damaging him professionally and otherwise, every opportunity which the law allows should be given to exculpate him;p1f However, Grant had faith in the integrity of his former jslamate, the prosecutor and principal witness against Porter, and believed that a courtmartial, composed of officers of high rank, some of whom were of known ability and honor, could not have been deceived. He yielded to the importunate expostulations of the prosecutor and to the statements of officials on whom he felt he could rely, and withheld the order. Senate, Feb; 21, 1870 Sir - You introduced a resolution in the Senate of the United States, on the twenty-first February, "Requesting the President to communicate to the Senate, if not inconsistent with the public interests, any recent correspondence in his possession in relation to the case of Fitz John Porter." On the occasion of offering the resolution you delivered a speech which has gone into the public debates and been published, and which will ever remain on the record as the expression of the opinion of a Senator of the United States, not only on the impropriety and injustice of according to me a re-hearing - but on the justice of my sentence, even in the light of the new facts which I propose to bring before any tribunal the President may appoint to re-hear the case. Though you withdrew your resolution immediately after making your speech, the latter remains unanswered except by the generous words of the Hon. Henry Wilson, the chairman of the senate committee of military affairs during the whole war and since, who declared that he adhered to his formerly expressed opinion, that my case was, under the new evidence brought to light, a proper one to be re-heard. Indeed the withdrawal of your resolution was more prejudicial to me than the original offering of it; for if not withdrawn, the correspondence called for would have shown in a great measure the truth, and my title to a re-hearing. It is a noble and a senatorial office, "to vindicate the truth of history," and you assured the Senate and the country that that was the object of your speech. May I not ask, that you will read this, my letter to you, which is intended to show that you fell into grave errors in your endeavor to do justice to history. From the report of the board of officers General Schofield, General Terr, and Colonel Getty convened to examine and report on the evidence on which General Porter was cashiered, it appears, (page 3, ) in their own words, that "While the Army of the Potomac was withdrawing from its position on the James River in August, 1862, the Army of Virginia under General Pope was ordered to hold the line of the Rappahannock, and to stand on the defensive until all the forces could be united behind that river. "General Pope was given to understand that when this concentration was effected Major-General Hal leek, the commander-in-chief, was to take the field in command of the combined armies. On the other hand, it appears that General McClellan, of the Army of the Potomac, was given to understand that he was to direct the operations of all the forces in Virginia as soon as they should be united. It appears further, that on the 25th of August Pope was Secretly informed that an active or offensive campaign was immediately to be commenced without any union of the forces, and under some other commander than Halleck or McClellan. Which commander turned out to be himself, or really McDowell, by whom the orders, and evidence, and operations plainly prove that they were misdirected and bedevilled for the next five days 26 th to 30th August. Green, Comptroller of the City of New York; December 2, 1875 Sir - On the 2d of September you addressed a letter to His Honor the Mayor, reflecting upon his supposed inattention to what you were pleased to term the wasteful expenditure of the public moneys through this Department. The Mayor forwarded the letter to me - an unnecessary attention on his part, as yon do not detain an expectant public - but, disregarding the restraints of official courtesy, promptly give your official correspondence to the press. To your letter I replied, September 20th, and sought to answer your allegations, because, holding an office of dignity and power, you are, by some people, supposed to be, what I purpose to show you are not, a person whose statements are entitled to respect. My correspondence with yon and about you has, thus far, been conducted with patience and courtesy.
