Extinctive Prescription on the Limitation of Actions:Reports of the XIVth Congress, International Academy of Comparative Law, Athens (Vouliagmeni), Greece 31 July-7 August 1994
Author: International Academy of Comparative Law
Publisher: Springer
ISBN:
Category : Law
Languages : en
Pages : 428
Book Description
Extinctive Prescription / On the Limitation of Actions contains sixteen national reports and the general report on the subject, written for the XIVth Congress of the International Academy of Comparative Law, held from 31 July-August, 1994, in Athens, Greece. The volume deals with limitations of actions, or `extinctive prescription', as the subject is usually called in civil law jurisdictions. This is both a highly technical and a highly political topic. The book focuses on the political aspects of extinctive prescription; specifically, how long should prescription periods run, as of what event, interrupted by which circumstances, etc. The trend in modern legislation has been to shorten the periods of extinctive prescription. Recent occurrences in biology and medicine, however, have led to proposals to lengthen the limitation periods again. The reports discuss the situation in Europe, Latin America, and North America, and are especially interesting because of their comparative nature.

Comparative Foundations of a European Law of Set-Off and Prescription
Author: Reinhard Zimmermann
Publisher: Cambridge University Press
ISBN: 1139434624
Category : Law
Languages : en
Pages : 196
Book Description
The emergence of a European private law is one of the great issues on the legal agenda of our time. Among the most prominent initiatives furthering this process is the work of the Commission on European Contract Law. The essays collected in this 2002 volume have their origin within this context. They explore two practically very important topics which had hitherto been largely neglected in comparative legal literature: set-off and 'extinctive' prescription (or limitation of actions). Professor Zimmermann lays the comparative foundations for a common approach which may provide the basis for a set of European principles. At the same time, the essays provide practical examples of the arguments that can be employed in the process of harmonising European private law on a rational basis. They explore topics such as the comparative experiences in the various modern legal systems and the direction in which the international development is heading.
