The implementation of Safety Management Systems at international airports was one of the most considerable changes in the regulatory framework for the operation and licensing of aerodromes in recent years. However, even more than five years after its inception it appears that the high expectations ICAO has placed on what has been designed as paradigm shift in the way of doing business in the airport industry were not materializing and Safety Management Systems appear at best to only marginally impact the safety performance of airports. Based on the lessons learned from the implementation of SMS in Germany an ideal organizational set-up for a most effective aerodrome SMS shall be designed. This proposal of an ideal organizational set-up shall be validated through a model implementation at a representative airport and subsequent long term observation in live operation. This model implementation serves as a basis from which recommendations for a future European regulation of Aerodrome Safety Management Systems under the EASA system shall be derived.

Master's Thesis from the year 2010 in the subject Engineering - Aerospace Technology, grade: 1,3, University of Applied Sciences Wildau (WIT Wildau Institute of Technology), course: Aviation Management, language: English, abstract: With the amendment of the European Regulation (EC) No 216/2008 by the new Regulation (EC) No 1108/2009 (into force since 14 December 2009), the area of competency of the European Aviation Safety Agency (EASA) is progressively extended towards a “total system approach” including ATM, ANS as well as airport safety and interoperability. This new regulation allows airport operators to continue with providing apron management service – but they have to “declare their capability“ for offering this service within the certification process of the aerodrome. An advanced surface movement guidance and control system is one important tool for providing this service at large and complex airports. With the implementation of an advanced surface movement guidance and control system (A-SMGCS), the airport contributes to the precise surface guidance of aircraft to and from a runway while maintaining safe distance to each other as well as to obstacles and vehicles. The system is aimed to assist the ground controllers in managing the traffic situation on the movement area in all weather conditions. Due to advanced surveillance technology, the ground movement controllers are able to continue operations with an A-SMGCS even in low visibility conditions (e.g. due to fog) and maintaining nearly the same capacity as with no visibility restrictions. The focus of this master thesis is not on the operational and technical details of the system, which are profoundly analyzed and elaborated on by R&D projects, e.g. by the German Aerospace Center (DLR), European research projects and the industry. However, the second chapter will provide those details required to fully understand the legal and administrative aspects of an A-SMGCS. If ANSP are using a system like A- SMGCS under safety aspects, they have to undergo a licensing process according to SES-regulations and are licenced by the national supervisory authority. The airport itself is licenced by the appropriate approving authority of the federal state. For Germany’s biggest airport, Frankfurt International Airport, it’s the ministry of transport of Hesse, the HMWVL. This ministry licences the airport as such as well as the safe provision of apron management service including the use of procedures and technical systems like A-SMGCS. The conditions for this approval are subject of the Master's Thesis.

This book reviews and critically analyzes the current legal framework with regard to a more just culture for the aviation sector. This new culture is intended to protect front-line operators, in particular controllers and pilots, from legal action (except in the case of willful misconduct or gross negligence) by creating suitable laws, regulations and standards. In this regard, it is essential to have an environment in which all incidents are reported, moving away from fears of criminalization. The approach taken until now has been to seek out human errors and identify the individuals responsible. This punitive approach does not solve the problem because frequently the system itself is (also) at fault. Introducing the framework of a just culture could ensure balanced accountability for both individuals and complex organizations responsible for improving safety. Both aviation safety and justice administration would benefit from this carefully established equilibrium.

International regulatory requirements are addressed by ICAO.The ICAO is an agency of the United Nations and was established in 1944 through a convention on International Civil Aviation (Lavenex 2008, 938). The organization develops standards that cover all aspects of aviation including safety. Through its Standards and Recommended Practices (SARPS), it provides the foundation of all safety regulations at a global scale. It oversees the development of safety regulatory framework by Member states through Universal Safety Oversight Audit Programme (USOAP). In recent years, ICAO requirements have been extended to require the implementation of a formal safety management by aviation service provider organizations as well as aircraft operators (Mclay 2008). Regional regulatory arrangements is a layer that cedes National Regulatory functions to supra-national agencies.
