Si la déontologie est difficilement identifiable, elle entretient des relations avec le droit. La confrontation des deux notions met en lumière, d'une part, la singularité des règles déontologiques par rapport au droit étatique. Cette spécificité se manifeste tant par sa production corporative que par ses caractères ; la déontologie apparait comme une règle de droit particulière au sein d'un ordre juridique distinct de l'ordre juridique étatique. La déontologie est engendrée par certaines institutions dont l'activité savante requiert la confiance des tiers. Elle devient ainsi l'un des instruments de défense de l'intérêt collectif de groupes cohérents de professionnels ou de sportifs. Le droit disciplinaire qui sanctionne les atteintes a la deontologie, s'avère également comme un droit corporatif dont les principaux traits sont distincts du droit commun. D'autre part, la déontologie, même si elle revêt des habits originaux, ne peut échapper à l'emprise d'un droit étatique envahissant. Les relations entre ces deux ordres normatifs sont complexes et réciproques. L'idéologie déontologique par l'intrusion de normes floues et négociées imprègne ainsi le droit pour en modifier la substance. Le droit de l'État s'introduit également largement dans la sphère déontologique. Il contrôle la déontologie formelle par le biais des codes de déontologie. Il modèle le comportement du « bon praticien » par la voie des standards déontologiques. La « publicisation » de la déontologie par des outils classiques atteste d'un degré supérieur de la récupération étatique, même si le juge respecte largement l'autonomie corporative.

The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law (PECL). The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
