En nuestro continente, la Declaración Americana de los Derechos y Deberes del Hombre, la Convención Americana sobre Derechos Humanos y demás instrumentos del corpus iuris interamericano representan el marco de protección de los derechos humanos de las personas migrantes y sus familiares. A partir de dichos instrumentos, y en ejercicio de sus respectivas competencias, la Comisión Interamericana de Derechos Humanos y la Corte Interamericana de Derechos Humanos han desarrollado estándares fundamentales para la consolidación de dicha protección. A través de los capítulos de esta obra colectiva se pretende contribuir a mejorar el entendimiento de la dimensión de los estándares interamericanos en materia migratoria y explorar su potencial impacto transformador. El proceso de interamericanización de los ordenamientos jurídicos nacionales evidencia una tendencia hacia la protección de los derechos humanos de las personas migrantes en América Latina y, en esa medida, orienta el cumplimiento de las obligaciones estatales de respeto y garantía. Ello se suma al impulso de los demás actores de la comunidad de práctica en la región para cumplir el mandato transformador de la Comisión y de la Corte Interamericanas. En síntesis, la interamericanización, como uno de los procesos que apalancan la construcción del ius commune en el ámbito de la movilidad humana, conlleva una relevante visibilización de los avances logrados y hace posible dar voz a las personas migrantes y a sus familias y, entre ellas, a quienes han sido víctimas de violaciones a sus derechos humanos.
