Esta investigación ofrece una explicación detallada acercade las consecuencias que debe afrontar el Estado y el proponente al incumplirlos mandatos legales y constitu­cionales que sirven de fundamento al derecho ala consulta previa en comunidades indígenas en un contrato de obra pública.Bajo esta óptica, la autora fundamenta dichas consecuencias en casosjurisprudenciales y determinaciones gubernamentales en el estudio de losprincipios y reglas establecidas en torno a la consulta previa. Los argu­mentosque componen esta investigación analizan en principio el desarrollo históricode la consulta previa con una descripción del derecho como tal, luego establecelas obli­gaciones que nacen del mismo y, finalmente, determina sus límites enel ordenamiento jurídico. A partir de la teoría establecida, la investigaciónprofundiza en las consecuen­cias que se presentan cuando el Estado contrata unaobra e incumple el deber de rea­lizar la consulta previa de la manera indicada,e identifica los límites establecidos por la jurisprudencia y las decisionesgubernamentales. De esta manera, se proporciona una orientación para entenderlos puntos clave en la celebración de un contrato de obra pública, cuyaejecución tiene efectos en territorios indígenas, descifrando los elementos quedeben darse para reparar a los pueblos indígenas en el caso de incumplimientode los requisitos para realizar la consulta previa.
