This draft Bill comprises three parts with four schedules, and it contains measures designed to facilitate more consistent, targeted and effective regulatory enforcement through a) the establishment of a statutory corporation, to be known as the Local Better Regulation Office (LBRO), in England and Wales; and b) the introduction of a new expanded framework for regulatory sanctions in the UK which will enable Ministers to confer on specified regulators new civil sanctioning powers, in relation to particular criminal offences, including fixed monetary penalties, discretionary requirements and enforcement undertakings. This Draft Marine Bill (Cm. 7351, ISBN 9780101735124) contains the following: a policy paper; the draft Marine Bill and explanatory notes; an impact assessment. The Bill sets out the Government's approach to a number of marine related issues, including environmental protection of the coastal marine environment and the seas surrounding the coast as well as access to the coastal environment for recreation. The legislation set out in this Bill was originally proposed in "Sea Change", a Marine White Paper, published in March 2007 (Cm. 7047, ISBN 9780101704724). The White Paper itself had proposed a strategic system of marine planning to balance conservation, energy and resource needs, using the principle of sustainable development. In this monograph, Aistė Mickonytė examines the compliance of the European anti-cartel enforcement procedure with the presumption of innocence under Article 6(2) of the European Convention on Human Rights (ECHR). The author maintains that the pursuit of manifestly severe punishment with insistence of the European Commission on administrative-level procedural safeguards is inconsistent with the robust standards of protection under the Convention. Arguing that EU anti-cartel procedure is criminal within the meaning of the Convention, this work considers this procedure in light of the core elements of the presumption of innocence such as the burden of proof and the principle of fault. The author zeroes in on the de facto automatic liability of parental companies for offences committed by their subsidiaries.
