Excerpt from Implementation of Indian Gaming Regulatory Act, Vol. 2: Oversight Hearing Before the Subcommittee on Native American Affairs of the Committee on Natural Resources, House of Representatives, 103rd Congress, 1st Session, on Implementation of Public Law 100-497, the Indian Gaming Regulatory Act of 1988 Class I gaming includes social or traditional gaming which is played in connection with tribal ceremonies or celebrations. Class I gaming is regulated exclusively by the tribes. Class II gaming includes bingo and, if played at the same location as bingo, pull tabs, lotto, punch boards, tip jars, and instant bingo. Class II gaming also includes card games which are authorized by state law or not explicitly prohibited by state law and played at any location in the state. The card games must be played in conformity with state law or regulations regarding hours of operation and pot limits. A tribe may engage in Class II gaming if the state in which the tribe is located permits such gaming for any purpose by any person, organization or entity. Class II gaming is regulated by the National Indian Gaming Commission and the tribe or solely by the tribe if issued a certificate of self-regulation. Class III gaming includes all gaming not included in Class I or Class II, such as casino-type games, gambling devices, pari mutuel betting, etc. Class III gaming is prohibited unless authorized by a tribal state compact.
