Excerpt from Digest of the Decisions of the Supreme Court of Iowa, Vol. 3: From the 35th to the 46th Iowa Reports, Inclusive Tm: author of this volume really owes an apology for the lateness of its appearance, but as apologies are seldom held sufficient to excuse a default, it would be a waste of words to now employ them for that purpose. It is proper to say, however, that a desire to make the volume correspond in site to the two preceding ones could not very well have been subserved by issuing it with less material than is furnished by the twelve volumes of Reports it embraces, and for the appearance of which he has had to wait. As it is, he has made the matter more capious than he otherwise would, in order to give the necessary compass to the volume. In this respect he has given it more elaborateness than is usually found in ordinary digests, frequently embodying in connection with the points stated extracts from the opinions, containing the reasonings from which the deductions presented are drawn. As there was a sufiiciency of space for this, it will, it is believed, not be looked upon as objectionable; it is hoped rather that it will be regarded as investing the work with additional value, especially by those who are not in possession of the Reports themselves. The same may be said in respect to the presentation in connection with each point stated, of all the authorities cited by the court in support of its conclusion. The Table of Cases cited, followed, overruled, etc, which, it was announced in the outset, would constitute a feature of the volume, it is also believed will meet with general favor, and serve a most useful purpose to the practitioner. It fre quently happens that the principle involved in a particular case, becomes not so directly involved in a subsequent one as to appear either in head-note or index, yet the case may have been in some manner referred to, perhaps approvingly, disapprovingly, or as explanatory; and this fact, which may prove of superior advantage in the solution of a question or in the argument of a case, may be readily ascertained by means of the key furnished in this.
