Zur näheren Bestimmung der Stellung der Arbeitnehmer- und Arbeitgebervereinigungen im BetrVG wird auffällig schnell und häufig auf das Grundrecht der kollektiven Koalitionsfreiheit zurückgegriffen. Die nähere Untersuchung dieses Grundrechts zeigt jedoch, daß das einfach-gesetzlich manifestierte Verhältnis der Koalitionen zur Betriebsverfassung allein Ausdruck eines an die öffentliche Gewalt gerichteten »Konkurrenzverbotes« ist. Daher sind nur diejenigen Normen in bezug auf Art. 9 Abs. 3 GG relativ verfassungsfest, die verhindern, daß das Betriebsverfassungssystem zu einer funktionsgefährdenden Konkurrenz für die Koalitionen erwächst. Dieses Ergebnis gilt ebenso für das SprAuG sowie für das EBRG. Mit der Arbeit der Autorin wird unter anderem gezeigt, daß vor allem im Bereich der tarifvertragsschützenden Normen der Gewährleistungsgehalt der kollektiven Koalitionsfreiheit wesentlich weniger weit reicht, als zahlreiche Stellungnahmen der arbeitsrechtlichen Literatur vermuten lassen. Letztlich wird auch die Frage, ob das Grundrecht der kollektiven Koalitionsfreiheit Grenzen für eine Öffnung des Tarifvertrages im Sinne von § 77 Abs. 3 Satz 2 BetrVG enthält, zugunsten einer weitgehenden Öffnungsbefugnis beantwortet.

Auf beiden Ebe nen geht es nicht nur urn die rechtliche Ausgestaltung der Koalitionsfreiheit. Viel mehr werden auch die Bereiche und das Umfeld koalitionsmaBiger Betatigung vorge stellt und zur Koalitionsfreiheit in Beziehung gesetzt. Ausgehend vom Wirtschaftsy stem der Bundesrepublik entsteht so eine Gesamtschau der Koalitionsfreiheit, welche tiber Tarifautonomie, Tarifvertragsrecht, Arbeitskampfrecht hinaus die faktischen Verhaltnisse der Koalitionen, ihre innere Struktur, ihr Verhaltnis zu den Mitgliedern beschreibt, die Bedeutung der Koalitionsfreiheit fUr die Betriebsverfassung und Unternehmensverfassung abtastet, die Koalitionsfreiheit zur sozialen Selbstverwal tung durch offentlichrechtliche Korperschaften (Sozialversicherungstrager, Bundesan stalt fUr Arbeit, Industrie-und Handelskammern, berufsstandische Kammern, Arbeit nehmerkammern) in Beziehung setzt und die Wahrnehmung der Arbeitnehmerinter essen im allgemeinpolitischen Bereich darstellt. Hauptanliegen des Rundblickes ist es, das Geflecht der Zusammenhange sichtbar zu machen. This book is about international humanitarian law or - as it is also called - the "law of armed conflict"or "law of war". It emerged from a series of lectures delivered at the Hague Academy of International Law.
