El derecho penal, tradicionalmente se ha divido en una parte general, conocida como la teoría del delito, y otra especial, donde se estudian los tipos penales. En esta confluyen la parte general del derecho penal, como es la tipicidad, el dolo, la culpa la preterintencionalidad y todos los demás elementos de la teoría del delito. De igual forma encontramos los elementos normativos, que nos aportan las otras ramas del saber jurídico, como es el caso en el CC, encontramos, por ejemplo, cuando comienza la vida y cuando termina, importantes concepciones estas en los delitos de homicidio. La obra que hoy presentamos al público, tiene por objeto no solo estudiar las figuras jurídicas protegidas con el derecho a la vida y la integridad de las personas, sino plantear y estimular el estudio comparativo de los países de habla hispana, sobre el derecho penal especial. Es por esto que el lector encontrará jurisprudencias colombianas y españolas, así como citas doctrinarias de ambos países, ya que en definitiva ambos Estados tienen la constitución como fundamento piramidal de su ordenamiento jurídico, donde la jurisprudencia y la doctrina, juegan un papel preponderante. Se parte de un estudio dogmático de los delitos que atentan contra la vida, basado en el fundamento constitucional y de derechos humanos. Es por esto que se encuentran abundantes citas de tratados y convenios internacionales sobre la materia, que hoy por hoy se incluyen ya como textos refundidos en la propia carta fundamental, como bloque de la constitucionalidad. Finalmente señalamos, que en la presente obra se estudian de manera didáctica todos y cada uno de los delitos que atentan contra la vida, donde se analizan los verbos rectores de cada tipo penal, la acción, el dolo, la culpa, el bien jurídico protegido, la penalidad, todo con el apoyo de la doctrina y la jurisprudencia, así como de las normas legales.
