It is undeniable that, the higher the cargo is stowed in a ship, the less is the stability gained and I cannot think it a wise practice in a ship which has developed an usual list. The Crown, moreover, is in every case the prosecutor These two propositions are so clearly established that we need not justify them. The Crown is clearly a party to this appeal (2). But the Ordinance of 1888 introduced what was not in the Ordinance of 1852--the private individual who institutes a crirai al prosecution. By Article 142 an agent, manager or employe may pro-ecut for an offence committed to the prejudice of his employer. Article 143 begins in these terms: "Whenever the prosecutor, being a private party, abandons the prosecntion and the opening words of Article 144 are: "When a criminal prosecution-shall have been instituted by a private individual.' It therefore seems to us that, if a private individual can be prosecutor, there is no reason why he should not be a respondeat. An amicus curiae, has drawn our attention to a passage in Dickinson's Quarter Sessions, where, in dealing with the subject of appeal from justices to Quarter Sessions, it is said--if the statnte does not mention the parties to whom notice of appeal should be given--the prosecuting party and the Magistrate should be made respondents, and if there be no individual prosecutor, the Magistrate should be respondent (3). We think that it is singularly clear that the individual prosecutor was rightly summoned in this case, and that, in this Colony especially, no exception can be taken to the representation of the Crown, and the (2) Stephen's Commentaries, Vol. 2, 508. (3) 4th Ed. 590. Magistrate who is entrusted with the judicial attributes of the Crown, by the Procurenr General. Mr. Sauzier's objection must therefore fail. JUDGMENT OF THE HON. OLIVER SMITH.
