In recent years the English criminal justice system has been shaken to its foundations by an unprecedented series of miscarriages of justice. The Guildford Four, the Maguire Seven, the Birmingham Six, Judith Ward and Stefan Kiszko are among the most prominent of those eventually cleared of serious crimes after many years in prison. While the sheer numbers of cases involved are troubling, it is the underlying causes of wrongful conviction which threw the system's credibility into question and led to the establishment of the Royal Commission on Criminal Justice chaired by Lord Runciman. In the early 2000s, federal enforcement efforts sent white collar criminals at Enron and WorldCom to prison. But since the 2008 financial collapse, this famously hasn’t happened. Corporations have been permitted to enter into deferred prosecution agreements and avoid criminal convictions, in part due to a mistaken assumption that leniency would encourage cooperation and because enforcement agencies don’t have the funding or staff to pursue lengthy prosecutions, says distinguished Columbia Law Professor John C. Coffee. “We are moving from a system of justice for organizational crime that mixed carrots and sticks to one that is all carrots and no sticks,” he says.
