Book Description
Excerpt from A Treatise on the Law of Evidence in Criminal Issues: On One Volume IN the four years which have elapsed since the pub lication of the eighth edition of this volume, nearly one thousand cases have appeared bearing on the particular topics it discusses. Most of these cases are affirmatory of the positions taken in the text, and are noted as such but many of them present new distinctions which it has been necessary to introduce in detail. The task has been labo rions; but it has not been without interest. The vast increase of reported cases, while adding to the value of treatises in which these cases are cited and classified, is preparing the way for the adoption of a general national system of criminal law in which local peculiarities will be gradually absorbed. Of this an interesting illustration will be found in a case hereafter noticed, ' in which the Su preme Court of Massachusetts, a State remarkably reten tive of judicial traditions, has abandoned, on a question of great importance, in deference to the Opinions of other courts and of the profession at large, a position which. Book Description
Excerpt from Report on Criminal Remedies in Massachusetts for Failure to Furnish Support: Report No. 7, August, 1916 Criminal Remedies in Massachusetts for Failure to Furnish Support. The rapid growth in recent years of criminal remedies for failure to furnish support, developing at last into the Uniform Desertion Act, St. 1911, c. 456, amended by St. 1912, c. 264, c. 310, St. 1914, c. 520, the Illegitimate Children Act, St. 1913, c. 563, and the Destitute Parents Act, St. 1915, c. 163, has created a need for a practical monograph upon the subject. While uni formity of decision and procedure among the seventy lower courts of the Commonwealth, as well as in the Superior Court, is most desirable, differences in sentences and methods still exist, in cases brought under these acts. The committee trusts that this mono graph may lead to uniformity in practice and greater effectiveness in the solution of the problems presented in cases of this character. Book Description
Excerpt from Address of His Excellency George N. Briggs to the Two Branches of the Legislature of Massachusetts: January 13, 1846 This state of moral feeling on the part of prisoners, is an important point gained in the administration of penal law. There is a small library in the institution which is much used by the prisoners during the hours that they are in their cells. The Inspectors and Warden concur in the opinion that an ad dition of suitable books is desirable. I think one or two hun dred dollars, for that purpose, from the prison funds, would tend to improve the moral condition of its unfortunate inmates. In connection with this subject, I deem it preper to call your attention to another important branch of the criminal law of the Commonwealth. By existing Statutes, there are four crimes punishable with death z - Treason, Murder, Rape, and burning a dwelling-house in the night-time.
