La «banalidad del mal» (o, si se prefiere, la pedestre vulgaridad del malvado) es también el asunto que afronta Slavenka Drakuli&ć en su viaje al corazón de las tinieblas balcánicas. ¿Qué son, monstruos patológicos o seres ordinarios? ¿Cómo es posible que individuos perfectamente respetables se envilezcan hasta el extremo de participar en el exterminio de sus vecinos? ¿Cómo es posible que los miembros de sus tribus respectivas celebren la abyección y protejan luego al abyecto? ¿Qué haríamos nosotros, inocentes criaturas, en circunstancias similares? Éstas son algunas de las preguntas que se hace la autora tratando de explicarse los móviles y los principios éticos de quienes perpetraron indecibles fechorías durante el conflicto yugoslavo de los años noventa. Drakuli&ć maneja fuentes muy diversas, pero su reflexión deriva principalmente de lo observado en los juicios por crímenes de guerra celebrados en La Haya. A partir de esas observaciones elabora escalofriantes retratos de individuos conocidos o anónimos acusados de asesinatos, violaciones o torturas, entre ellos Slobodan Miloševi&ć, ex presidente de Serbia, Radislav Krsti&ć, primer condenado por genocidio , Biljana Plavši&ć, única mujer procesada, y Ratko Mladi&ć, jefe del ejército serbiobosnio, que sigue prófugo. Pero el eco de las preguntas aquí planteadas rebasa las fronteras de la difunta Yugoslavia. ¿Nos alzaremos, como el fariseo parabólico, a proclamar una virtud construida sobre la maldad ajena? ¿Sabremos hallar entre nosotros (o tal vez en nosotros) a quienes han sepultado la piedad bajo el pesado obelisco del amor a la patria? Slavenka Drakuli&ć es licenciada en literatura comparada y sociología por la universidad de Zagreb. Tras una brillante trayectoria como periodista, narradora y ensayista, se vio obligada a abandonar Croacia a principios de los noventa cuando algunas de las revistas más importantes (y nacionalistas) de su país la declararon «insuficientemente patriota». Con una extensa obra traducida a más de 15 idiomas, Drakuli&ć es uno de los autores croatas más leídos en todo el mundo. This book puts forward proposals for solutions to the current gaps between the Mexican legal order and the norms and principles of international criminal law. Adequate legislative measures are suggested for compliance with international obligations. The Rome Statute, unlike the statutes of the International Criminal Tribunals for the former Yugoslavia and for Rwanda, creates a permanent court whose dormant jurisdiction covers the territory and includes the nationals of States Parties and is universal in cases where the Security Council makes a referral. Besides, unlike the "ad hoc" tribunals, which have jurisdiction over specific crisis situations whose personal, territorial and temporal parameters have been defined in their respective statutes by the UN Security Council, in the case of the ICC it is not possible to determine a priori in which situations the ICC will be involved. As a result, the most relevant activity of the Court is the determination of those situations regarding which the dormant jurisdiction of the Court will be triggered. The book "The Triggering Procedure of the International Criminal Court" constitutes the first comprehensive analysis of the proceedings that, prior to any criminal investigation, aim to make such a fundamental determination.
