This publication brings together the texts adopted by the Standing Committee of the Congress of Local and Regional Authorities of the Council of Europe. The Congress, a consultative body of the Council of Europe, is made up of two chambers: one representing local authorities, the other the regions. Its aim is to reinforce democratic structures at local and regional level, and in particular to help the newly-emerging democracies in central and eastern Europe. The Congress adopts three different types of texts: recommendations, opinions and resolutions. Recommendations are proposals to the Committee of Ministers, and their application is left up to each member government. Sometimes they are also addressed to other international organisations. Opinions usually refer to questions to the Congress from the Committee of Ministers or the Parliamentary Assembly. The Committee of Ministers and the Parliamentary Assembly consult the Congress on questions which are likely to affect the competence and the basic interests of the local and regional authorities which the Congress represents. Resolutions reflect the decisions that the Congress is authorised to take, or make recommendations to local and/or regional authorities and their associations.

Since its foundation, the Council of Europe has established a common legal system for European states, based on democracy, the rule of law and human rights. Its standard-setting texts have helped its members meet the challenges of changing societies and now apply all over Europe given the organisation¿s unprecedented geographical enlargement since 1989. In this connection, the Council of Europe has played a key role in the accession of the new member states to the European Union. The first section of the book deals with the "constitutional" law of the Council of Europe, or its internal statutes in the broad sense. It covers the 1949 Statute, which, along with related texts, lays down the Council¿s aims and determines its membership and operating methods. Youth participation is not an end in itself, but a means of achieving positive changes in young people’s lives and of building better democratic societies. Participation is a fundamental human right recognised, among others, in the Universal Declaration of Human Rights and the Convention on the Rights of the Child. Participation is also a core principle of human rights and is a condition for effective democratic citizenship for all people. The aim of the Council of Europe’s youth policy is to provide young people with equal opportunities and experience which enable them to develop the knowledge, skills and competencies to play a full part in all aspects of society. Youth participation is at the core of youth policy in the Council of Europe, which includes co-management as a form of sharing power with youth representatives. Youth participation is promoted across the various sectors of the Council of Europe. The revised European Charter on the Participation of Young People in Local and Regional Life, adopted in May 2003 by the Congress of Local and Regional Authorities of the Council of Europe, is a standard-setting instrument for youth participation. It supports young people, youth workers, youth organisations and local authorities in promoting and enhancing meaningful youth participation at local and regional level across Europe. The manual “Have your say!” was produced to support local and regional authorities, youth organisations and young people who want to give young people a real say for a meaningful democratic youth participation. According to the Charter, participation is about having the right, the means, the space and the opportunity and, where necessary, the support to participate in and influence decisions and engage in actions and activities so as to contribute to building of a better society. The manual “Have your say!” is an educational and practical tool to support all those committed to making that right a reality for more young people in the Council of Europe member states.

The Parliamentary Assembly of the Council of Europe publishes a volume of adopted texts for each of its four part-sessions and Standing Committee meetings. The Assembly, or the Standing Committee on its behalf, can adopt three different types of texts: opinions, recommendations and resolutions. Opinions are mostly expressed by the Assembly on questions put to it by the Committee of Ministers, such as the admission of new member states to the Council of Europe, but also on draft conventions, or the budget. Recommendations contain proposals addressed to the Committee of Ministers, the implementation of which is within the competence of governments. Resolutions embody decisions by the Assembly on questions which it is empowered to put into effect or expressions of views for which it alone is responsible. They can also be addressed to national parliaments. References to committees: the Bureau of the Assembly decides whether communications, in particular from the Committee of Ministers and from the Secretary General, and motions for recommendations and resolutions should be referred to the appropriate committee for action, if any. Referrals are then ratified by the Parliamentary Assembly.
