El presente Código, nace con la vocación de convertirse en un manual de referencia para el Derecho de la Energía y de consulta para el profesional inmerso en el mismo, al codificar con comentarios y jurisprudencia relacionada las principales normas del ordenamiento jurídico en la materia. La obra da a conocer los aspectos más relevantes, fundamentalmente para su comprensión, estudio y correcta aplicación, de las principales normas y preceptos que presiden y conforman el panorama legislativo español del sector energético (electricidad, gas y petróleo, principalmente). El constante nacimiento de normas jurídicas y económicas, la no muy abundante presencia de pronunciamientos jurisdiccionales, y la complejidad y particularidad del sector, lo convierten en un referente imprescindible de la interpretación del Derecho en un ámbito fuertemente regulado y especializado. La estructura que sigue la obra permite la consulta íntegra de las normas, ya sea de rango legal, reglamentario, o incluso inferior de que se trate, en la cual precepto por precepto se insertan los comentarios y las referencias (legislativas y jurisprudenciales) más importantes. La estructura del Libro distingue tres grandes partes: la primera es la relativa a normas comunes, esto es, Constitución española, Estatutos de Autonomía o Directivas. En la segunda, relativa a energía eléctrica, se diferencia la normativa general; actividades liberalizadas (generación y comercialización); actividades reguladas; tarifas, peajes y gestión económica del sistema; energías renovables y eficiencia energética. En la tercera parte, dedicada a hidrocarburos, se distingue además del comentario a la Ley 34/1998, del Sector de Hidrocarburos, la parte dedicada a exploración e investigación; gas natural, petróleo y biocarburantes. El presente libro, prologado por Luis Atienza, Presidente de Red Eléctrica de España, constituye un hito en el ámbito de los Códigos comentados, alumbrando y poniendo a disposición de empresas, Abogados y el mundo jurídico en general, las principales normas del sector energético comentadas por dos conocidos juristas de reconocido prestigio, ambos Abogados del Estado, que en el pasado y en actualidad respectivamente, han desempeñado el cargo de Abogado del Estado-Jefe en la Secretaría de Estado de Energía, y que por tanto resultan ser profundos conocedores de la materia.
