The cruel power of misdirected words, artfully structured but spiritually empty and bearing the stamp of law or legalistic reasoning, is a persistent theme in the modern novel. Richard Weisberg, who has written extensively on both literature and law, explores the role of legalism and its abuses in eight major novels of the nineteenth and twentieth centuries. Beginning with Dostoevski and moving by way of trenchant analyses of Flaubert and Camus, Weisberg culminates his argument in a brilliantly revisionist reading of Melville's Billy Budd. In each of the novels treated, Weisberg sees a verbally gifted central character relying on wordiness to avoid or distort previously revealed truths. He argues that the malaise Nietzsche called ressentiment goads these characters to verbalizations that do violence to others and, ironically, indict their very creators. He identifies the legalistic theme as the major mode of iconoclasm in modern fiction and the source of its holocaustic vision. Writers, he reflects, viewed with profound skepticism their culture's tendency to substitute complex narrative formalism for earlier, absolute approaches to justice. For just over fifty years John Stuart Mill contributed articles and letters to the newspapers, setting before the public a radical position on contemporary events. From 1822 to 1873, in newspapers as widely read as The Times and the Morning Chronicle, and as narrowly circulated as the True Sun and the New Times, he praised his friends and damned his opponents, while commenting on a while range of issues at home and abroad, from banking to Ireland, from wife-beating to land nationalization. His main series of newspaper writings concerned France (especially during the first four years of the Revolution of 1830) and Ireland (especially during December 1846 and January 1847, when various proposals for relief of the starving cottiers were being debated). Mill felt himself peculiarly fitted to explain French affairs and Irish solutions to the non-comprehending and wrong-headed English. But his pen was wielded wherever he say stupidity and narrowness, and he found them in astonishingly varied areas. He tried to explain to his obdurate countrymen the first principles of law reform, political economy, relations between the sexes, democracy, international law, and much more. Virtually none of these texts have been reprinted before this volume. The Introduction by Ann Robson sets the items in their historical and personal perspective, and draws out the implications for Mill's life and thought. The Textual Introduction by John Robson gives an account of the sources of the texts, and lays out principles and methods followed in the editing. The Mill that emerges from these pages is a fighting journalist, uninhibited, forthright, and often brilliantly satirical, testing his theoretical opinions in the real world, gradually maturing and developing a practical philosophy whose influence has been felt well into our own time.

Criminal justice procedure is the bedrock of human rights. Surprisingly, however, in an era of unprecedented change in criminal justice around the world, it is often dismissed as technical and unimportant. This failure to take procedure seriously has a terrible cost, allowing reform to be driven by purely pragmatic considerations, cost-cutting or foreign influence. Current US political domination, for example, has produced a historic and global shift towards more adversarial procedure, which is widely misunderstood and inconsistently implemented. This book addresses such issues by bringing together a huge range of historical and contemporary research on criminal justice in Europe, Asia, Africa, Australasia and the Americas. It proposes a theory of procedure derived from the three great international trial modes of 'inquisitorial justice', 'adversarial justice' and 'popular justice'. This approach opens up the possibility of assessing criminal justice from a more objective standpoint, as well as providing a sourcebook for comparative study and practical reform around the world.
