La monografia tratta il tema relativo alla ridefinizione dei criteri di imputazione della tutela lavoristica, a fronte degli epocali mutamenti nell’organizzazione delle imprese e nel mercato del lavoro. L’opera dimostra l’insufficienza a fini qualificatori dell’elemento dell’eterodirezione e propone il superamento della dicotomia subordinazione/autonomia, non più idonea a cogliere le nuove forme di lavoro ed a tal fine propone un diverso criterio di imputazione delle tutele lavoristiche, quello della dipendenza economica. La categoria della dipendenza economica evoca infatti la nozione di dipendenza di cui all’art. 2094 c.c., intesa quale inserimento continuativo nell’organizzazione produttiva altrui, da cui discende la dipendenza economica del prestatore. E ciò nella prospettiva della piena attuazione dell’art. 35 Cost. e nella consapevolezza che la tutela costituzionale del lavoro prescinde da qualificazioni tecnico-giuridiche di tipi contrattuali ed ha come destinatario il lavoratore-soggetto debole nel rapporto/mercato del lavoro.

Labour Law and Sustainable Development is a detailed reconstruction of the regulatory framework and jurisprudential findings of sustainable development at the international, European and national level. The global crisis of the past decade has underlined the social unsustainability of the ultra-liberalistic theories through which the labour law deregulation represents the precondition for social and economic development coherent with the globalization imperatives. It is no exaggeration to assert that the existing foundations of labour law have been irreversibly compromised. It is essential to find a way out of the crisis, at the same time defining the founding values of new sustainable labour law. In linking labour law with the sustainability paradigm, this provocative book promises to widen the scope and terms of the reconciliation of interests, taking into account the multiplicity of the stakeholders interested in economic, social and environmental issues and, in particular, to practise an approach that achieves intergenerational equity. The sharing economy is just one of several possible expressions to designate the complex model of social and economic relationships based on the intensive use of digital technology. Constant permutations and combinations allow these relationships to be established through the intervention of a third party making traditional contractual positions flexible in such a way that today’s employee is tomorrow’s entrepreneur, or today’s consumer is tomorrow’s supplier of goods and services. The current legal framework is, in many respects, unable to accommodate such big changes and new legal regulations are required where adaptation of the existing ones proves to be inadequate. This book highlights where changes are needed and where adaptations are required, with a particular focus on the Portuguese, Spanish, Italian, British and Brazilian contexts. For that, four different approaches are undertaken, namely the meta-legal, macro-legal, micro-legal and transnational approaches. The study that results from these different approaches enables readers to acquire a general view on the current legal problems arising from the sharing economy, and was a direct result of a research project of the Centre for Legal and Economic Research, at the University of Porto, funded by Fundação para a Ciência e Tecnologia.
