The fact that about 30-40% of the adults in the Western world are overweight or obese testifies to the frequency of the disturbances in body weight regulation. Scientists have established that caloric intake, macronutrient composition of the diet, basal and resting metabolic rate, thermic response to food, energy expenditure associated with movement and physical activity, and preferential storage of the surplus of calories as fat or lean tissues are critical determinants of energy balance and body weight. While much has been learned, the field is poised for major advances with the advent of a variety of imaging techniques, progress in quantitative and molecular genetics, use of transgenic rodent models and of breeding experiments with informative inbred strains, availability of stable isotopes for metabolic and behavioral studies, and a growing number of useful experimental animal and human models. This volume takes an integrative approach to obesity. It is structured around four major topics: (1) the animal and human models currently available for the study of body weight regulation with their strengths and limitations, (2) the molecular and genetic basis of the regulation of body weight, (3) the metabolic and physiological mechanisms involved, and (4) the behavioral and social determinants. Rediscovering the Law of Negligence offers a systematic and theoretical exploration of the law of negligence. Its aim is to re-establish the notion that thinking about the law ought to and can proceed on the basis of principle. As such, it is opposed to the prevalent modern view that the various aspects of the law are and must be based on individual policy decisions and that the task of the judge or commentator is to shape the law in terms of the relevant policies as she sees them. The book, then, is an attempt to re-establish the law of negligence as a body of law rather than as a branch of politics. The book argues that the law of negligence is best understood in terms of a relatively small set of principles enunciated in a small number of leading cases. It further argues that these principles are themselves best seen in terms of an aspect of morality called corrective justice which, when applied to the most important aspects of the law of negligence reveals that the law - even as it now exists - possesses a far greater degree of conceptual unity than is commonly thought. Using this method the author is able to examine familiar aspects of the law of negligence such as the standard of care; the duty of care; remoteness; misfeasance; economic loss; negligent misrepresentation; the liability of public bodies; wrongful conception; nervous shock; the defences of contributory negligence, voluntary assumption of risk, and illegality; causation; and issues concerning proof, to show that when the principles are applied and the idea of corrective justice is properly understood then the law appears both systematic and conceptually satisfactory. This book analyses the common law's approach to retroactivity. The central claim is that when a court considers whether to develop or change a common law rule the retroactive effect of doing so should explicitly be considered and, informed by the common law's approach to statutory construction, presumptively be resisted. As a platform for this claim a definition of 'retroactivity' is established and a review of the history of retroactivity in the common law is provided. It is then argued that certainty, particularly in the form of an ability to rely on the law, and a conception of negative liberty, constitute rationales for a general presumption against retroactivity at a level of abstraction applicable both to the construction of statutes and to developing or changing common law rules. The presumption against retroactivity in the construction of statutes is analysed, and one conclusion reached is that the presumption is a principle of the common law independent of legislative intent. Across private, public and criminal law, the retroactive effect of judicial decisions that develop or change common law rules is then considered in detail. 'Prospective overruling' is examined as a potential means to control the retroactive effect of some judicial decisions, but it is argued that prospective overruling should be regarded as constitutionally impermissible. The book is primarily concerned with English and Australian law, although cases from other common law jurisdictions, particularly Canada and New Zealand, are also discussed. The conclusion is that in statutory construction and the adjudication of common law rules there should be a consistently strong presumption against retroactivity, motivated by the common law's concern for certainty and liberty, and defeasible only to strong reasons. Trace metals occur as natural constituents of the earth's crust, and are ever present constituents of soils, natural waters and living matter. The biological significance of this disparate assemblage of elements has gradually been uncovered during the twentieth century; the resultant picture is one of ever-increasing complexity. Several of these elements have been demonstrated to be essential to the functions of living organisms, others appear to only interact with living matter in a toxic manner, whilst an ever-decreasing number do not fall conveniently into either category. When the interactions between trace metals and plants are considered, one must take full account of the known chemical properties of each element. Consideration must be given to differences in chemical reactivity, solubility and to interactions with other inorganic and organic molecules. A clear understanding of the basic chemical properties of an element of interest is an essential pre-requisite to any subsequent consideration of its biological significance.
