A quasi un anno dall’entrata in vigore del codice dei contratti pubblici “D.Lgs. n. 36 del 31 marzo 2023”, e a qualche mese dall’avvio della digitalizzazione, è parso opportuno soffermarsi su procedure ed istituti che si sono ormai stabilizzati, ma non senza criticità operative. Il volume intende affrontare questo obiettivo dai due diversi punti di vista: quello della stazione appaltante e quello dell’operatore economico. Le norme sono le stesse, ma diversi sono gli obiettivi e le possibili letture. In questo contesto il lavoro è diviso in due sezioni: una dedicata più direttamente alle stazioni appaltanti e la seconda agli operatori economici, con alcuni capitoli trasversali come quello legato al PNRR 4 approvato con la recente legge di aprile 2024. Ogni argomento è trattato attraverso un’analisi operativa, la segnalazione di prassi, pareri e giurisprudenza di questo primo anno di applicazione.
