Así pues, y dado que es la decisión final de inversión la que permite la canalización del ahorro hacia la inversión productiva, función económica esencial del sistema financiero en general, y del mercado de valores en particular, se plantea como necesario atender a analizar en qué medida puede el derecho servir al desarrollo de las estrategias y objetivos de financiación directa pretendidos desde el mercado de valores, y si proporciona o no, un marco legal de protección tal que le dote de la suficiente confianza (fiducia) para proceder a la incentivación en la inversión de los productos financieros. Por ello, conforma el objetivo genérico de la presente obra el análisis de la normativa reguladora del mercado de valores con la pretensión de tratar de observar su incidencia en el contenido de las relaciones jurídicas que se mantienen en el mercado en aras de poder advertir si el marco legal por el que se procede a su regulación permite dotar a todos los operadores del mercado de las garantías legales necesarias sobre la base de un Ňvalor añadidoň implícito tal que le posibilite desplegar sus efectos en la contratación.
