Dos son los elementos que marcan la ordenación actual del arbitraje laboral en el ordenamiento jurídico español, su defenestración expresa del régimen jurídico previsto en la ley de arbitraje común -Ley 60/2003, de 23 de diciembre (art. 1.4)- y su desarrollo mediante la autonomía colectiva, fuente especial y exclusiva del Derecho del Trabajo. Partiendo de ellos, y más exactamente, de las modalidades de arbitraje laboral que configuran una y otra, y en el marco de convivencia entre la jurisdicción y los mecanismos extrajurisdiccionales de resolución de disputas, el autor propone una senda en la que desgranan todos los elementos del arbitraje laboral. Se analizan los órganos arbitrales y su composición, la participación de las partes contendientes en esta técnica, el proceso arbitral y su resultado (el laudo arbitral) y la relación del arbitraje laboral con otras técnicas de resolución del conflicto, extrajurisdiccionales y jurisdiccional, y con las medidas de presión. Al tiempo que se describe la regulación vigente existente, se muestran sus defectos y fortalezas, concretando un análisis crítico que nos lleva a demostrar que, efectivamente, la solución de las controversias laborales constituye uno de los grandes temas pendientes en la construcción del sistema de relaciones laborales postconstitucional.
