Alberta Bill 40, the Health Information Act, has three main components. It gives individuals a right to access their health information; provides rules regarding the collection, use, and disclosure of health information; and provides for a commissioner to conduct independent reviews of decisions made by information custodians and to resolve complaints. This report presents the Information & Privacy Commissioner's evaluation of various aspects of Bill 40. It begins with an overview of the features of the Act, then discusses the case for access to health information, the entities that are entitled under the Act to access health information without consent, the benefits of the Act for Albertans, and specific concerns about the draft of Bill 40. Issues discussed include the application of the Bill to the private sector, exceptions to access, use of health information for research purposes, collection or use of personal health numbers, notice and disclosure requirements, and public scrutiny of regulation-making powers. The final section reviews how the Commissioner responded to Bill 30, the Health Information Protection Act of 1997, and the changes that have occurred since then.
