A number of concerns have been raised with respect to advance directives. Advance directives are intended to allow a person who is currently capable of giving informed consent to determine how they are to be treated at a later time at which they are not competent to give such consent. For example, an advance directive such as a living will might specify that should a patient face severe dementia, certain forms of treatment should not be provided if needed to prolong life. Or an individual might fill out a do-not-resuscitate order asking not to be revived in the event of a heart attack. This article discusses three distinct arguments that have been offered against the legitimacy of some or all advance directives. After laying out each argument, focus is given to a potential response to one of the arguments in particular, an argument labelled the “Ignorance Argument”. The argument contends that the potential application of any advance directive is plagued by a host of epistemic issues that are serious enough to hamper the very expression of autonomy advance directives are designed to allow for. A possible response to the argument is developed. The response suggests that the argument may place unduly severe constraints on the type of self-knowledge needed to underwrite the expression of a person's autonomy through the creation of an advance directive. The response identifies some connections between the different arguments. An answer is also given to a recent criticism, offered by Eric Vogelstein (2016), which questions the existence of the type of autonomy needed to underwrite advance directives.

This book investigates the relationship between our present and future selves. It focuses specifically on diachronic self-regarding decisions: choices involving our earlier and later selves, in which the earlier self makes a decision for the later self. The author connects the scientific understanding of the neurobehavioral processes at the core of individuals’ perceptions of their future selves with the philosophical reflection on individuals’ moral relationship with their future selves. She delineates a descriptive theory of the perception of the future self that is based on empirical evidence and that systematizes and integrates the current theoretical literature. She then argues for the morality of prudence and interprets diachronic self-regarding decisions as decisions between two agents— the earlier and later selves—that belong to the realm of intergenerational ethics, which regulates the relationship between contemporary people and future generations. Finally, the author provides a moral theory of prudence based on respect for one’s agency. This theory identifies what the present and the future selves owe to one another in diachronic self-regarding decisions. The first time I read the medical consent and authorization. it had registered in my mind simply as a legal document. Now I began to understand what it meant. It was a letter of ultimate love and trust. (Schucking. 1985. p. 268) Ever since Karen Ann Quinlan slipped into permanent unconsciousness in 1975 and her father agonized publicly over whether she should remain indefinitely on a respirator (In re Quinlan, 1976), the desires of patients, their families, and their friends to limit the application of apparently limitless medical technology have been a pressing concern for ethics, law, and public policy. Ms. Quinlan's case contained nearly all the elements of the problems we still face: vague, general, but sincere prior oral statements suggesting that she would not want continued treatment; a family attempting to do what they saw as best for her; and physicians uncertain whether to use medical judgment alone (and if so, what the "right" medical decision was), to preserve her life at all costs, or to honor the family's interpretation of their daughter's choice. Most ironically, once she was removed from her respirator, she did not die.
