Nonattainment New Source Review (NSR) (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Nonattainment New Source Review (NSR) (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The EPA is finalizing revisions to the regulations governing the nonattainment new source review (NSR) program mandated by section 110(a)(2)(C) of the Clean Air Act (CAA or Act). These revisions implement changes to the preconstruction review requirements for major stationary sources in nonattainment areas in interim periods between designation of new nonattainment areas and adoption of a revised State Implementation Plan (SIP). The revisions conform the nonattainment permitting rules that apply during the SIP development period following nonattainment designations before SIP approval to the Federal permitting rules applicable to SIP-approved programs. The changes are intended to provide a consistent national program for permitting major stationary sources in nonattainment areas under section 110(a)(2)(C) and part D of title I of the Act. In particular, these changes conform the regulations to the NSR reform provisions that EPA promulgated by notice dated December 31, 2002, except that these changes do not include the NSR reform provisions for "clean units" or "pollution control projects," which the U.S. Court of Appeals for the D.C. Circuit vacated in New York v. EPA, 413 F.3d 3 (DC Cir. 2005). In addition, these changes include an interim interpretation of the NSR reform provision for a "reasonable possibility" standard for recordkeeping and reporting requirements, in accordance with that court decision. This interim interpretation to the "reasonable possibility" standard applies for appendix S purposes, pending the completion of rulemaking to develop a more complete interpretation. No other region in America is so fraught with projected meaning as Appalachia. Many people who have never set foot in Appalachia have very definite ideas about what the region is like. Whether these assumptions originate with movies like Deliverance (1972) and Coal Miner's Daughter (1980), from Robert F. Kennedy's widely publicized Appalachian Tour, or from tales of hiking the Appalachian Trail, chances are these suppositions serve a purpose to the person who holds them. A person's concept of Appalachia may function to reassure them that there remains an "authentic" America untouched by consumerism, to feel a sense of superiority about their lives and regions, or to confirm the notion that cultural differences must be both appreciated and managed. In Selling Appalachia: Popular Fictions, Imagined Geographies, and Imperial Projects, 1878-2003, Emily Satterwhite explores the complex relationships readers have with texts that portray Appalachia and how these varying receptions have created diverse visions of Appalachia in the national imagination. She argues that words themselves not inherently responsible for creating or destroying Appalachian stereotypes, but rather that readers and their interpretations assign those functions to them. Two times there was a wholesale destruction of Jacksonville's official records – in the War Between the States and by the fire of May 3, 1901. The author's effort in this work was to collect all of the available authentic matter for permanent preservation in book form. The record closes as of December 31, 1924. The record is derived from many sources – long forgotten books and pamphlets; old letters and diaries that have been stored away as family memorials of the past; newspapers beginning with the St. Augustine Herald in 1822 (on file at the Congressional Library at Washington) fragmentary for the early years, but extremely valuable for historical research; almost a complete file of local newspapers from 1875 to date; from the unpublished statements of old residents of conditions and outstanding events within the period of their clear recollection; and from a multitude of other sources of reliability. The search through the highways and the byways for local history was in the spare moments of the author stretching over a period of a score of years, a pastime "hobby" with no idea of making money out of it. No attempt has been made to discuss the merits of any incident, but only to present the facts, just as they were and just as they are, from the records and sources indicated.
