Evaluer scrupuleusement le succès, les difficultés et les perspectives d'avenir de la protection des droits de l'homme dans le monde arabe, c'est appréhender l'objet d'étude, en tant que processus et non pas en tant qu'objectif qui se réaliserait spontanément. La problématique des droits de l'homme dans le monde arabe doit être conçue dans ses aspects juridiques, économiques et religieux. L'ordre juridique interne arabe ne manque pas de textes légaux assurant une protection relative aux droits fondamentaux. L'effectivité de cette protection semble pourtant faire défaut. Nous devons situer les droits et les libertés dans une perspective historique, afin de déceler les facteurs de progrès, de régression ainsi que les risques de fractures. La Charte arabe des droits de l'homme adoptée par la Ligue des Etats arabes en 1994 constitue incontestablement un progrès par rapport à la situation de non droit qui prévaut dans le monde arabe. Le contenu normatif de cette Charte témoigne d'une conception assez proche de la Charte internationale des droits de l'homme. Cette approche a malheureusement pour contrepartie une certaine pauvreté technique dans le mécanisme de protection des droits consacrés d'où la nécessité de moderniser ladite Charte. Si la Charte arabe des droits de l'homme constitue un pari sur l'avenir du monde arabe vers l'émergence d'un système régional de protection des droits fondamentaux, reste aux peuples visés, mais aussi aux Etats arabes et aux organisations internationales à créer les conditions nécessaires permettant d'asseoir fermement cet acquis et veiller à ce que l'individu puisse bénéficier de la consécration non seulement des droits civils et politiques mais également des droits économiques, sociaux et culturels.
