The Commons Home Affairs Committee "deplores" News International's attempt to "deliberately thwart" the original investigation into phone hacking in 2005-06 but also states that the police set aside a huge amount of material that could have identified other perpetrators and victims. The committee agrees with John Yates's own assessment that his 2009 review of this investigation was "very poor", that he did not ask the right questions and that he was guilty of a "serious misjudgement". The committee criticises Andy Hayman's cavalier attitude towards his contacts with those in News International who were under investigation which, even if entirely above board, risked seriously undermining confidence in the impartiality of the police, and accuses him of deliberate prevarication in order to mislead the committee. It urges the swift and thorough investigation of allegations that payments were made to police officers by the media, which will help to establish whether or not such payments may have influenced police inquiries into phone hacking. The committee welcomes DAC Sue Akers's decision to contact all potential victims of phone hacking by the News of the World as part of the current investigation, but is alarmed that only 170 have as yet been informed. At this rate it would take years to inform all of the several thousands of people potentially affected. The committee therefore recommends that extra resources are allocated to her investigation, by the Government directly if necessary. The committee also expresses concern about both the scope and understanding of current laws on phone hacking, with prosecutors and police still arguing over the meaning of relevant sections of the Regulation of Investigatory Powers Act 2000. However, this was no reason for the Metropolitan Police to limit their investigation of these matters. Finally, potential victims of phone hacking should be given a means of seeking formal advice from the Information Commissioner and easier access to redress. The Information Commissioner should be given additional powers to deal with breaches of data protection, including phone hacking and blagging. Mobile phone companies should give greater prominence to security advice in the information provided to their customers. The report sets out 24 conclusions and recommendations.

This inquiry addresses police forces' use of RIPA powers to acquire communications data in the course of investigations. In two recent, high-profile cases, police have used RIPA powers to obtain material which might be regarded as journalistic material for the purposes of PACE. In the Metropolitan Police's Operation Alice (the investigation into the so-called "Plebgate" incident and subsequent events), the Metropolitan Police accessed a journalist's telephone records to establish whether the information provided to his newspaper might have emanated from within the MPS. In Kent Police's Operation Solar (the investigation into perversion of the course of justice by Constance Briscoe in relation to the trial of Rt Hon Chris Huhne and Vicky Pryce) the police used RIPA powers to obtain material from Associated Newspapers Limited (ANL) after an application by the police for access to the material under PACE had already failed because ANL had successfully claimed in court that journalistic privilege applied.

The Committee focused on the police response, the costs of policing the disorder, and the role of social media, all of which were looked at in the context of wider public policy. The causes were only looked at in so far as they offered lessons to reduce the likelihood of similar disturbances occurring again. The Committee concluded that ultimately the disorder was quelled by increased numbers of police officers on duty and flooding the streets with police. In the initial stages this did not happen and the operation to police the disorder in many towns and cities, and particularly in London, is seen as flawed. The single most important reason why the disorder spread was the perception, relayed by television as well as social media, that in some areas the police had lost control of the streets. The death of Mark Duggan was a significant factor in the disorder that took place in Tottenham. A potentially tense situation was made worse by failures of communication on the part of the Metropolitan Police and the Independent Police Complaints Commission. Those who took part in the disorder did use social media to communicate with each other, but television also played a part in spreading the disorder. All police forces should have a communication strategy in place so in the event of a credible threat of severe public disorder all businesses in the affected area are given early and consistent advice about what action they should take

The Home Affairs Committee is content for the Home Secretary to proceed with Mr Winsor's appointment. This is considered against the background that his nomination was controversial. If appointed he will be the first Chief Inspector who has never served as a police officer. They urge Mr Winsor to reach out to forces, police officers of all ranks and their representative bodies to build bridges. He must create a strong relationship with forces and with police and crime commissioners. The Home Affairs Committee will take a continued interest in the work of the Chief Inspector and look forward to hearing evidence from him on a regular basis

In this report the Committee criticises the UK Border Agency for failing to explain why 350 foreign national prisoners due to be deported are still in the country. The Agency provided the Committee with a breakdown of the issues with the deportation process of 1,300 prisoners who were released between 1 April 2010 and 31 March 2011. The largest group, making up 27% of the total, was labelled 'unknown'. The Committee also found that the Agency has not resolved all of the asylum 'legacy' cases first identified in 2006 within the promised 5 year timeframe. Instead, 18,000 ongoing cases are still awaiting a final decision. The Committee highlights its concern at the dramatic increase in files transferred to the "controlled archive" - where the Agency has lost contact with individuals - in the past six months. The files, which are placed in the archive when every effort to track an applicant has been exhausted, numbered 40,500 in March 2011. By September 2011, it had increased to 124,000. A series of specific recommendations are made: the Government should commission a detailed investigation into financial waste, included the writing-off of bad debts, overpayments to staff and asylum applicants, and failure to collect civil penalties; there should be better liaison between the Agency and HM Prison Service; the Agency is losing too many appeals at immigration tribunals and should raise the quality of its representation; all staff must be aware of the existence of "bogus colleges", which exist only to sponsor visa applications.

The Agency's backlog is growing at an alarming rate-it has increased by over 25,000 cases since the first quarter of this year. The backlog consists of: the Migration Refusal Pool which contains records of individuals without leave to remain in the UK, who cannot be traced and has grown by 24,000 records since the first quarter of this year-it now totals 174,000; ex-Foreign National Offenders with 3,954 ex-FNOs living in the community whilst deportation action against them proceeds; the so-called 'controlled' archive with cases the Agency has no control over, it does not even know where the applicants are -there were 95,000 cases in archive' at the end of June this year and senior management promised to clear it by 31st December which would mean writing off 81,000 files; Asylum and migration live cohorts where the UKBA has managed to trace an applicant thought to have been lost and is working to close their case- with 29,000 cases in the live cohorts at the end of June this year. The UKBA must adopt a transparent and robust approach to tackling the backlogs instead of creating new ways of camouflaging them. Until the entire backlog is cleared the Committee does not believe that senior staff should receive any bonuses. The Committee also doubts that the Agency is adequately equipped to deal with the increase in asylum applications. Cases waiting for an initial decision after 6 months have risen by 36% since June 2011. The Committee is further concerned about the quality of decision making. Poor decision making may result in people being returned home when they face persecution and torture

This report considers the events surrounding the police raid on 14 August of the home of Sir Cliff Richard OBE in Berkshire, and the circumstances under which the BBC came to have advance information about the raid. It concludes that South Yorkshire Police's handling of this situation was inept. The naming of suspects (or the confirming of a name when it is put to a force) when there is no operational need to do so is wrong. South Yorkshire Police should not have tried to cut a deal with the journalist, but rather approached senior BBC executives to explain the damage that such premature disclosure could do to the investigation. The BBC's Director General, Lord Hall, confirmed to the Committee that the BBC would act on such requests from Chief Constables. In the absence of any such approach from South Yorkshire, the BBC was well within its rights to run the story, although as a result Sir Cliff himself has suffered enormous, irreparable damage to his reputation. It appears that the BBC reporter clearly identified the source of his leak as Operation Yewtree. It is unfortunate therefore that South Yorkshire Police did not notify the Metropolitan Police so that the source of the Yewtree leak could be investigated.

Whilst it supported a number of steps the Government has taken in its 2010 drug strategy, it believes more needs to be done to comprehensively address the drugs problem in the UK. The report focuses on the need to 'break the cycle' of drug addiction, and highlights in particular the need for improved treatment in prisons and wider society, and for early intervention with better education and preventative work. Three key areas were covered: prisons; treatment and the calling for the establishment of a Royal Commission into the issues. The Committee was disturbed to find that almost a quarter of prisoners found it easy to get drugs in prison and recommended that measures such as regular random drug tests based on suspicion be increased. It was concerned that the Government's policy of recovery was not being implemented, in particular that drug rehabilitation in prison was undermined by the lack of support for offenders on release, and did not take into account prescription drug addiction. The Committee is also concerned that the goal of retaining addicts in treatment has precluded attempts at recovery. It supported the Government's objective of recovery but noted that this will require a range of treatment options, with each individual needing a tailored treatment plan. The Committee highlighted residential rehabilitation and the use of buprenorphine as an alternative to methadone as two treatment methods which were currently under-utilised. Treatment must also be supplemented by housing, training and employment support if required

This report concludes that it is getting easier for anyone to advertise themselves as a private investigator - with modern communications and cheap surveillance devices - and while the industry remains unregulated, a number of serious risks remain. The Committee explores the risks of the involvement of private investigators in the justice system and law enforcement and the threat of corruption those links entail. The Committee recommends that the Government set up a robust licensing and registration system as soon as possible. Private investigators and their companies should be governed by a new Code of Conduct for Private Investigators. Under this system a criminal record for breach of section 55 should disqualify individual from operating as private investigators. It also proposes that dealings between police and investigators should be recorded and that there should be a one year cooling off period between serving as a police officer and entering the investigation industry. While recognising the honest contribution made by most private investigators, this report highlights the involvement of some private investigators in an illegal market in personal data and calls again on the Government to strength the penalties for data offences. The Committee also calls on the Independent Police Complaints Commission to take direct control over investigations in cases alleging police corruption in relation to private investigators

The Committee were shocked by the scale of bullying that was found at the Federation's Headquarters. It is disgraceful that any Chairman should have been hounded out for championing the long-overdue reforms set out in the Normington Report. Only a new National Chair, elected directly by the Federation's rank-and-file members, will have the authority to implement these changes in full. At a local level, while some smaller branches struggle financially, others have accumulated reserves which add up to around £35 million, some of it in obscure "No. 2" accounts. A new funding formula, with subscriptions going straight to the centre and being distributed to branches, would remedy this. Federation funds should serve the Members and the public directly, not the organisation itself. Police officer's from every corner of England and Wales should receive an immediate rebate on their current subscriptions, which have accumulated into unnecessary reserves of around £70 million, and a subscription freeze for next year. There needs to be full transparency of all the Federation's accounts, at both national and local level.. Our police service is the best in the world but its reputation has been extensively damaged by the Federation suffering a sustained period of self inflicted harm.
