The modern business instrument is the corporation. The development of the tendency through the instrument has resulted in the joining together, in varying forms, of corporate entities and properties. Corporate conjunction involves intercorporate relations, and the legal questions growing out of these relations furnish the subject-matter of this treatise. The preparation of the first four parts of this work has been a process of amplification; of the last part, a process of reduction. The conjunction of corporate entities through consolidation, of corporate properties through sales and leases, and the concentration of corporate control through holding shares, are outlined in general treatises upon corporation and railroad law. The material for the development of the subjects, in a manner commensurate with their importance, has, however, only been found through a systematic examination of original sources. The law governing combinations of corporations is more accessible, but less adaptable. The value of a mass of apparently conflicting decisions appears only when it is reduced to principles. In collecting the cases much assistance has been derived from the general treatises upon monopolies and similar subjects. Especial acknowledgment is due to Mr. Eddy's valuable work upon combinations of labor and capital ("Combinations"), although its underlying theory that a combination of capital, to be unlawful, must be a conspiracy, is the opposite of that of the present treatise.
