L'ouvrage analyse également les nouvelles dispositions de l'ordonnance du 25 juillet 2001 qui a transposé la directive du 13 octobre 1998 sur la protection des dessins et des modèles. Il commente par ailleurs le règlement du 12 décembre 2002 qui institue le modèle communautaire et le dépôt à l'OHMI. Ainsi, des développements particuliers sont consacrés à la réglementation des dessins et des modèles dans chacun des pays de l'Union européenne et en Suisse. L'auteur fait une étude comparée de ces régimes juridiques qui appliquent différemment le principe, adopté en droit français, de " l'unité de l'art " maintenu par la directive.

Protecting designs is complex and diverse; it involves deciding whether to protect them by design law, copyright law, or by both laws. A single protection may be under- or overprotective but two or more can be overprotective if there are no rules regulating the overlap.
