Excerpt from The Relations of the State University to Religion: An Address Delivered Before the Graduating Classes, on Sunday Evening, June 26, 1887, at the Semi-Centennial of the University In the year 1837, when Michigan was admitted to the Union, her University was also founded, in accordance with a provision of the new constitution, by the organization of the first Board of Regents; and the diplomas of the University are dated from that year as the first both of the University and of the State. We, therefore, now stand at the close of the first half century of the existence of the University of Michigan; and as we enter upon the celebration of an anniversary so interesting and suggestive, as we look back with gratitude to God for the wonderful prosperity He has given to the State and to all its munificent work of public instruction, we find many fruitful subjects of discourse; but I have chosen the one which seems especially adapted to the opening of our festival, and appropriate to this sacred day, "The University in its Relations to Religion." The people of Michigan adopted at the first, as a fundamental principle of their state polity, the idea of universal education at the public expense; education not only of the common school, but also in its higher grades, and in all its branches; education in all its breadth and compass, and accessible to all. Religious concerns stand at the center of international politics, yet key paradigms in international relations, namely realism, liberalism, and constructivism, barely consider religion in their analysis of political subjects. The essays in this collection rectify this. Authored by leading scholars, they introduce models that integrate religion into the study of international politics and connect religion to a rising form of populist politics in the developing world. This book presents a human rights-based assessment of the various modes of state religion identification and of the various forms of state practice that characterize these different state religion models. This book makes a case for the recognition of a state duty to remain impartial with respect to religion or belief in all regards so as to comply with people s fundamental right to be governed, at all times, in a religiously neutral manner. As this book demonstrates through the various case studies there is increasing interest and concern at the manner in which questions concerning the enjoyment of the right to the freedom of religion or belief bear upon key questions concerning the governance of democratic society. Issues raised involve matters concerning employment, education, expression, association and, more generally, the interface between religion and political life. The existing literature often traces these concerns back to the need to consider the place of religion in contemporary society but leaves matters there. Another body of academic literature explores the theoretical dimensions of that relationship but fails to connect it to the practice of states in order to test out the propositions which are the product of these reflections. The great virtue of this work is that is seeks to unite these various enterprises and engages head on with the challenges which this produces The aim is to demonstrate and illustrate the key contention: that there is an emergent right to religiously neutral governance, and that this is incompatible with the continuation of systems which offer preference to particular forms of belief system religious or otherwise. A chief virtue of this book is that it works through the consequences of this claim in a fearless fashion, posing challenges for those states which continue to use their legal frameworks to offer support (directly or indirectly) for historical, dominant or favoured forms of religion or belief. It challenges received assumptions and, by driving the logic of contemporary human rights thinking to the foundations of state-religion relationships performs a valuable service for those engaging with this most difficult and timely of questions. This comparative analysis of the constitutional law of religion-state relations in the United States and Germany focuses on the principle of state neutrality. A strong emphasis on state neutrality, a notoriously ambiguous concept, is a shared feature in the constitutional jurisprudence of the US Supreme Court and the German Federal Constitutional Court, but neutrality does not have the same meaning in both systems. In Germany neutrality tends to indicate more distance between church and state, whereas the opposite is the case in the United States. Neutrality also has other meanings in both systems, making straightforward comparison more difficult than it might seem. Although the underlying trajectory of neutrality is different in both countries, the discussion of neutrality breaks down into largely parallel themes. By examining those themes in a comparative perspective, the meaning of state neutrality in religion-state relations can be delineated.
