Governing Global Networks argues that most international regimes are grounded in states' mutual cooperation, and not in the dictates of the most powerful states. It focuses on the regimes for four important international industries - shipping, air transport, telecommunications and postal services. Of particular importance to these regimes have been states' interests in both the free flow of commerce and their policy autonomy. The authors examine the relationship between these potentially conflicting goals. In particular they trace the impact of deregulation, which has led some states increasingly to place gains from economic openness ahead of their desire to maintain a high degree of control of their own economies; and to the decline of the traditional cartel elements of these regimes. Many industries historically subject to economic price and entry controls have been largely deregulated, including natural gas, trucking, airlines, and commercial banking. The core structure of the regulatory regime for international civil aviation (the ‘Chicago System’) is inter–national. The features of the Chicago System were designed in an era when the world’s airlines were State–owned, and the most pressing international concerns were for navigation and safety regulation. This book indicates the shortcomings of the current international legal system and customary international norms that govern international aviation law to comply with contemporary air transport market realities. As the air transport market develops globally, the safety regime of civil aviation should also be governed and applied globally. In this book, the author departs from current international legal norms to examine the emerging legal field of global administrative law. Through that lens, the possibility of reconstructing the set of legal mechanisms that govern domestic and international administrative interaction in the global field of aviation safety is explored. This book demonstrates that a legal system is never complete but always develops in tandem with changing needs, i.e. the participation of the affected parties. Exploring the principles of GAL theory contributes to addressing the contemporary legal issues relating to state compliance with international aviation safety standards that would otherwise not be covered by customary international law.
