Recent years have seen a resurgence of interest, among both philosophers, legal scholars, and military experts, on the ethics of war. Due in part due to post 9/11 events, this resurgence is also due to a growing theoretical sophistication among scholars in this area. Recently there has been very influential work published on the justificaton of killing in self-defense and war, and the topic of the ethics of war is now more important than ever as a discrete field. Franciscan friars were everywhere in the early modern Catholic world, a world that stretched from the Americas, through Western and Central Europe, to the Middle East and Asia. This global brotherhood was as deeply entangled in the great religious wars that convulsed Europe during the sixteenth and seventeenth centuries as it was in the Spanish and Portuguese empires. While the political and imperial theories of Dominicans like Francisco de Vitoria and Bartolome de Las Casas, who took the theology of Thomas Aquinas as their starting point, are well-known, this has not been the case for Franciscan thinking until now. The Franciscans and their allies built a body of political writings around the theology of John Duns Scotus (1265/6–1308), and this book presents a wide selection of sixteenth- and seventeenth-century Scotist writings on politics, warfare, and empire in English for the first time. Beginning with Scotus’s own doctrine on the forced baptism of Jews, this collection translates John Mair (1467–1550) on European imperialism and holy war, Alfonso de Castro (1495–1558) on the Schmalkaldic War of the 1540s, Juan Focher (1497–1572) on the war against the Chichimeca Indians of Mexico, and John Punch on the British and Irish Civil Wars of the 1640s and 1650s. The availability of these primary sources for teaching and research will clarify the connection between religion, politics, and imperialism in the early modern world.

In his monumental On Justice and Rights, the Jesuit Luis de Molina (1535-1600) discussed the legal and ethical aspects of the Portuguese trade in African and Asian enslaved persons. Molina surveys, develops, and problematizes the criteria necessary for the legitimate possession, sale, and purchase of human freedom. He insists that, even under legally valid slavery, persons who have sold or lost their freedom have inalienable rights as human beings, such as the freedom to make contracts, to marry, and even, under certain circumstances, to sue their owners in court. Molina also devotes attention to the ways in which slavery could be ended and whether and under what circumstances slaves had the right to escape from their owners. Well informed about the political structures and customs of many peoples in Africa, as well as Japan, China, and India, Molina paints a vivid and detailed picture of Portuguese trade. He gives specific accounts of the origins and development of the slave trade, region by region, and of the nature of the relationship between local rulers and the Portuguese kingdom. In doing so, he carefully describes the deception, coercion, and general indifference that pervades this trade regarding the rights to freedom of these people. It also attempts to identify the political, ecclesiastical, and market agents involved in this great injustice and their varying degrees of culpability. While Molina does not condemn slavery as a legal institution, the deeply flawed and even immoral behavior of sellers, buyers, regulators, and political rulers both in Portugal and in the slave-supplying regions that Molina denounces casts a heavy shadow on the morality of the trade.
