Prevailing wage laws affecting the construction industry in the United States exist at the Federal and State levels. These laws require that construction workers employed by contractors on government works be paid at least the wage rates and fringe benefits 'prevailing' for similar work where government contract work is performed. The federal law (Davis-Bacon Act) was passed in 1931. By 1969 four fifth of States had enacted prevailing wage legislation. In the 1970s, facing fiscal crises, States considered repealing their laws in an effort to reduce construction costs, and since 1979 nine States have repealed their laws. These repeals at State level along with unsuccessful attempts to repeal the Davis-Bacon Act have pushed prevailing wages to the forefront of public policy and controversy. This book, for the first time, brings together scholarly research in the economics of prevailing wages placed in historical and institutional context.

For more than 100 years, New York State labor laws have required that tradespeople assigned to public work projects be paid the prevailing wage for the trade in which they are engaged. Compliance, however, is not universal or complete. Some contractors perpetually disregard the laws, successfully bidding for these competitive contracts with the knowledge that their labor costs will be greatly reduced over their law abiding competitors. Many New York State and New York City organizations and authorities take these laws seriously; limited training and manpower hinders their abilities to vigorously enforce these laws. While several organizations in the upstate New York area enforce these laws because they are the law, they have called for their repeal stating the laws burden taxpayers in counties with small populations. This project explores the adoption of an electronic certified payroll reporting system throughout New York State and the centralization of prevailing wage oversight and supervision through the New York State Department of Labor and the Office of the New York City Comptroller. It proposes that all tradespeople on public work projects be provided with a universal identification to be used in conjunction with an electronic or biometric timekeeping device. Using biometric timekeeping technology as a fraud detection mechanism would identify contractors who perpetually violate the law, and provide a simple way to validate claims made by underpaid tradespeople. Ultimately, this project suggests centralizing the release of funds for payment on all public work projects, thereby removing this function from the agency undertaking the project. This would ensure that tradespeople are paid the overtime to which they were entitled and would prevent contractors from corrupting the contract bidding process.
