A check is denominated a species of inland bill of exchange, - not with all the incidents of an ordinary bill of exchange, it it true, - but still it belongs to that class and character of commercial paper. Moses v. Frank lin Bank, 34 Md. 574. When an instrument is drawn upon a bank, or a person engaged in the banking business, and simply directs the payment to a party of a specified sum of money, which is at the time on deposit with the drawee, without designating a future day of payment, the instrument is to be treated as a check. Obviously the taxpayer is not entitled to recover or extinguish through amortization more than the difference between the war cost of such property and what he can sell the property for after the war, or if he continues to need and use it in his business, what it would have cost him after the war.
