In the opening days of the trial of Imam Jamil Abdullah Al-Amin (the former H. Rap Brown), the late Coretta Scott King, founder of the Atlanta-based Martin Luther King Center for Nonviolent Social Change, released a statement that read in part: "For justice to be faithfully served there must be no rush to judgment and the defense must be allowed to present all of its evidence, just as the prosecution must uphold the highest standards in meeting the burden of proof." Unfortunately, there was a rush to judgment, with exculpatory evidence favoring the accused deliberately left out of the judicial process. As a result, someone who many believe to be an innocent man has now marked 20 years of unjust imprisonment. Among those who question the legitimacy of Al-Amin's conviction and life sentence is another "civil rights icon" who testified as a character witness on behalf of the accused during the sentencing phase of his trial. Amid music festivals and moon landings, the tumultuous year of 1969 included an infamous case in the annals of criminal justice and Black liberation: the New York City Black Panther 21. Though some among the group had hardly even met one another, the 21 were rounded up by the FBI and New York Police Department in an attempt to disrupt and destroy the organization that was attracting young people around the world. Annotation. In 2000 and 2001, twelve northern states of the Federal Republic of Nigeria introduced Islamic criminal law as one of a number of measures aiming at "reintroducing the shari'a." Immediately after its adoption, defendants were sentenced to death by stoning or to amputation of the hand. Apart from a few well publicised trials, however, the number and nature of cases tried under Islamic criminal law are little known. Based on a sample of trials, the present thesis discusses the introduction of Islamic criminal law and the evolution of judicial practice within the regions historical, cultural, political and religious context. The introduction of Islamic criminal law was initiated by politicians and supported by Muslim reform groups, but its potential effects were soon mitigated on higher judicial levels and aspects of the law were contained by local administrators. In the context of a review of U.S. strategy in Afghanistan during September-November 2009, the performance and legitimacy of the Afghan government figured prominently. In his December 1, 2009, speech announcing a way forward in Afghanistan, President Obama stated that the Afghan government would be judged on performance, and "The days of providing a blank check are over." The policy statement was based, in part, on an assessment of the security situation furnished by the top commander in Afghanistan, General Stanley McChrystal, which warned of potential mission failure unless a fully resourced classic counterinsurgency strategy is employed. That counterinsurgency effort is deemed to require a legitimate Afghan partner. The Afghan government's limited writ and widespread official corruption are believed by U.S. officials to be helping sustain a Taliban insurgency and complicating international efforts to stabilize Afghanistan. At the same time, President Hamid Karzai has, through compromise with faction leaders, been able to confine ethnic disputes to political competition, enabling his government to focus on trying to win over those members of the ethnic Pashtun community that support Taliban and other insurgents.
