The member states of the EU have only very recently begun to consider race and racism in the framework of equality legislation and policies. As opposed to an established Anglo-Saxon tradition of naming races and using racial categorisation to fight racism, most continental European countries resist this approach. This book investigates the problematic reception and elaboration of race as a socio-legal category in Europe. The development of antidiscrimination policy in Europe closely mirrored European Union deepening in the 1990s, but its roots lie in developments during the 1980s. Actors in the European Parliament saw a political opening for action with the rise of the radical right in places like France and Germany. In the 1980s and early 1990s, racist acts of violence and the stunning success of radical right political parties across Europe catapulted the issues of immigration, xenophobia, fascism, and racism to the forefront. The European Parliament was only beginning to take on a more important role in the supranational structures that were under construction during the 1980s, but it would play a key role in the development of an anti-racism agenda and what would ultimately become racial antidiscrimination policy for the European Union. Legislating Equality begins by examining the evolving discourses around racism in Europe from the mid-1980s through the late 1990s. The authors then link these discourses and country level starting points to the political and social factors which influenced the development of antidiscrimination policy. Examining the role of the European Parliament, Commission, and key societal actors in the passage of the Racial Equality Directive in 2000. It then goes on to examine the transposition of the EU directives into national law and the implementation of antidiscrimination policy. Legislating Equality argues that these processes were impacted by the slow-down in European integration in the early 2000s as well as political pressure from more conservative governments than had initially passed the legislation at the EU level.

This book examines the substantive provisions of the Racial Equality Directive for Minority Protection (RED) and their implementation in four EU Member States (Belgium, Estonia, Hungary, and the Netherlands). The book follows the structure of the RED and consists of six substantive chapters, each of which corresponds with one aspect of the substantive section of the RED. Each chapter is divided into a theoretical part examining whether RED offers effective mechanisms for minority protection, as well as a practical part covering national case studies. The book concludes that the RED offers a range of possibilities to establish an inclusive and effective anti-discrimination regime on the national level and presents recommendations to make the RED more effective. The case study section of each chapter contains an overview of the way in which each of these four Member States has implemented the RED provisions. The study shows that the RED has a clear impact at the national level and has undeniably a converging effect, by producing, to a considerable extent, similar terms and concepts in national anti-discrimination law. It gives suggestions for improvement at the national level to further enhance minority protection, and it will be of interest to academics and professionals in the field of human rights, political science, and constitutional rights.

The European Union has committed itself to combating racism as a general objective of law and policy. EU legislation requires Member States to introduce laws prohibiting racial discrimination in many aspects of everyday life, including employment, education, healthcare, and housing. Alongside legislation requiring action at national level, the EU institutions have also made periodic commitments to 'mainstream' racial equality: taking anti-racism objectives into account within all areas of EU law and policy. This book analyses the extent to which the objectives of combating racism and promoting ethnic equality have been effectively mainstreamed throughout a wide range of EU policy fields. It begins by considering what combating racism means in the contemporary context of the enlarged EU. This paper analyzes the efficacy of EU interventions into the elimination of racial discrimination and improvement of labor market outcomes for racial and ethnic minorities in the EU, including the Race Equality Directive of 2000, soft law measures such as the Lisbon Strategy, the European Employment Strategy, Europe 2020 and the European Social Fund. The paper examines the application of the Racial Equality Directive, the European Employment Strategy and the European Social Fund in six European member states - three of the original member states (France, Belgium and the Netherlands) and three new member states (Hungary, Romania and Bulgaria). It finds that EU and member state efforts have resulted in improved labor market outcomes for racial and ethnic minorities in only a few isolated instances, despite the development of an overarching legal framework and significant investment of government financial resources. The paper was written under the guidance of Professors Roger Blanpain and Mijke Houwerzijl of Tilburg University Law School in Tilburg, Netherlands for completion of a Masters in Law (LL.M.) degree.

This thematic brochure is produced under the European Community Action Programme to combat discrimination (2001-2006). This programme was established by the European Commission's Directorate General for Employment and Social Affairs as a pragmatic support to ensuring effective implementation of the two Directives on "Race" and "Equal treatment in the workplace" (2000) emanating from Article 13 of the Amsterdam Treaty. The six-year Programme primarily targets all stakeholders capable of exerting influence on the development of appropriate and effective antidiscrimination legislation and policies, across the EU-25, EFTA and the EU candidate countries. The Action Programme has three main objectives. These are: 1. To improve the understanding of issues related to discrimination 2. To develop the capacity to tackle discrimination effectively 3. The Race Equality Directive: a Shadow Report collects lessons learned from the implementation of the Race Equality Directive in nine European Union member states. The Race Equality Directive is a piece of legislation adopted in 2000 by the Council of Ministers of the European Union implementing the principle of equality for all irrespective of racial or ethnic origin. The directive comes under review at the end of 2013, 10 years after its entry into force. The report includes data on Bulgaria, the Czech Republic, France, Germany, Hungary, Italy, the Netherlands, and Spain. Annex 1 contains summaries of the developments in each of these member states. The report identifies trends in the challenges facing the countries examined, examples of successful or problematic implementation, and includes recommendations for improving effective implementation. Challenges to the implementation of the Race Equality Directive include: *lack of disaggregated data needed to implement parts of this legislation and evaluate its effectiveness; *unclear identification of proxy categories that can be used to detect discrimination on the ground of racial and ethnic origin; *problems that impede effective access to and use of judicial (individual or collective) redress against discrimination; *hindrances to alternative forms of individual (or collective) redress, through the equality bodies.
