The Northern Ireland peace process has been heralded by those involved as a successful example of transformation from a violent conflict to a peaceful society. This book examines the implementation of the Belfast Agreement in Northern Ireland, and evaluates whether its goal to establish a normal, peaceful society has been fully realised. Using the political and legal status of England, Scotland and Wales as a comparison, Jessie Blackbourn evaluates eight aspects of Northern Ireland which the Agreement aimed to normalise: the contested constitutional status of Northern Ireland, the devolution of power, decommissioning, the removal of emergency laws, demilitarisation, police reform, criminal justice reform, and paramilitary prisoners. The book highlights the historical context which gave rise to the need for a programme of normalisation within the Belfast Agreement with respect to these areas and assesses the extent to which that programme of normalisation has been successfully implemented. By evaluating the implementation of the Belfast Agreement, the book demonstrates the difficulties that transitional or post-conflict states face in attempting to wind back extraordinary counter-terrorism policies after periods of violence have been brought to an end. The objective of this work is to provide an analysis of the legislative approaches to counter-terrorism and human rights in Australia, Canada, New Zealand and the United Kingdom. The text is aimed at lawyers and practitioners within and outside common law nations. Although the text analyses the subject within the four jurisdictions named, many parts of the book will be of interest and relevance to those from outside those jurisdictions. Considerable weight is placed on inter- tional obligations and directions, with a unique and hopefully useful feature of the text being the inclusion and consideration of a handbook written by me on human rights compliance when countering terrorism (set out in Appendix 4 and considered in Chap. 13). A signi?cant part of the research undertaken for this work was as a result of my being awarded the International Research Fellowship, Te Karahipi Rangahau a Taiao, an annual fellowship generously funded by the New Zealand Law Foun- tion. When we think of counterterrorism we often think of coercive measures, including expanded policing powers, extraordinary rendition, increased jail sentences, and no-fly lists. Yet, several countries also use surprisingly "soft" methods to deal with the rising problem of homegrown extremism--from debate training and sports competitions to citizenship education and information campaigns. Given the violent aims of homegrown extremists, why do states opt for this softer approach? In Hold Your Friends Close, Sarah Logan provides the first exploration of counter-radicalization policy and homegrown extremism through a theoretical and historical lens. Logan contends that unlike traditional counterterrorism, counter-radicalization is generally informed by ideals of citizenship and allegiance to the state as a panacea for the violence of homegrown extremism. Because the radicals these policies target are not loyal to their own state, but rather to the idea of a non-state based political or religious community, winning them back to their "home" state is the primary aim of counter-radicalization efforts. While there are some basic similarities in approach across countries, there are important divergences too. Logan argues that this stems from different ideas about the nature of citizenship and national belonging. To that end, Logan compares the different approaches of the UK and US, showing how they differ in important ways despite a basic focus on solidifying the target subject's allegiance to their home state. Providing the first detailed policy history of counter-radicalization in the US and the UK, as well as a comprehensive overview of counter-radicalization policies globally, Hold Your Friends Close is an essential read for scholars and policymakers who work on terrorism and its sources.
