La subcontratación en el sector de la construcción constituye hoy una realidad económica y productiva indiscutible, que es objeto de regulación jurídica. La novedad en esta materia se contiene en la Ley 32/2006, que aborda, por primera vez, un régimen que introduce garantías en la cadena de contratación y en la seguridad y salud de los trabajadores. Particularmente, las cautelas de la nueva Ley, desarrollada posteriormente por el RD 1109/2007, de 24 de agosto, descansan en la exigencia de determinadas condiciones para los niveles de subcontratación, en los requisitos de calidad o solvencia a las empresas que vayan a actuar, así como en los mecanismos de transparencia mediante exigencias documentales y el reforzamiento de la participación de los trabajadores en las distintas empresas que intervienen en la obra. Se trata, en suma, de una regulación de gran trascendencia, que plantea cuestiones y problemas aplicativos innegables, afectando al objeto y ámbito de la regulación citada, a los requisitos exigibles a los contratistas y subcontratista, especialmente, al registro de empresas acreditadas, al régimen de la subcontratación, a las figuras contractuales típicas del sector, a la intervención de los trabajadores autónomos, a la prevención del riesgo laboral y a las responsabilidades derivadas del incumplimiento de los nuevos deberes empresariales. El conjunto de cuestiones anudadas a esta normativa especial constituyen el objeto fundamental de análisis y estudio de la presente obra. En esta segunda edición, renovada y acomodada a la regulación de desarrollo de la Ley 32/2006, se pretende conocer en profundidad el alcance y los efectos de este novedoso régimen jurídico, de interés, sin duda, para todos los profesionales, así como para los propios empresarios, asesores y responsables jurídicos de las empresas que desarrollan su actividad en el sector de la construcción, y facilitar su aplicación, pasado ya un tiempo desde su entrada en vigor, asumiendo sus distintos contenidos especialistas acreditados en la materia.
