Presenting the first analytical overview of the legal foundations of the EU's Common Security and Defence Policy (CSDP), this book provides a detailed examination of the law and practice of the EU's security policy. The European Union's security and defence policy has long been the focus of political scientists and international relations experts. However, it has more recently become of increasing relevance to lawyers too. Since the early 2000s, the EU has carried out more than two dozen security and defence missions in Europe, Africa, and Asia. The EU institutions are keen to stress the security dimension of other external policies also, such as development cooperation, and the Lisbon Treaty introduces a more detailed set of rules and procedures which govern the CSDP. This book provides a legal analysis of the Union's CSDP by examining the nexus of its substantive, institutional, and economic dimensions. Taking as its starting point the historical development of security and defence in the context of European integration, it outlines the legal framework created by the rules and procedures introduced by the Treaty of Lisbon. It examines the military operations and civilian missions undertaken by the Union, and looks at the policy context within which they are carried out. It analyses the international agreements concluded in this field and explores the links between the CSDP and other external policies of the Union.

As the NATO combat mission in Afghanistan draws to an end, the ‘West’ is starting to take a hard look back at two decades of global stabilization efforts. The ‘lessons learned’ literature on these efforts is exploding. One of the dominant themes in this literature is the need to embed the specifically military toolkit into a much more comprehensive, integrated approach towards planning and executing. In this forward-looking report, HCSS goes a step further by focusing not on the operational but on the strategic level of decision-making. Today, this strategic layer is driven much more by domestic and international ‘politicking’ than by creative strategic thinking. This report advocates a new approach to strategic decision-making which we label ‘strategic design’. It summarizes and borrows some key insights from the ‘design thinking’ literature in the business and public management literature and applies those to the security challenges surrounding stabilization efforts. The report then illustrates this approach by developing and evaluating a few ‘design sketches’ for new capability elements that even a small force provider like The Netherlands could start developing. In the twenty-first century, the European Union is confronted by myriad security problems that demand concerted action and cooperation. As a negotiating power, it seeks to persuade Iran to forswear a nuclear weapons programme. As a crisis manager it seeks to contribute to global peace and stability through civilian and military operations. Closer to home, it is wrestling with questions about membership enlargement, large-scale migration and terrorist threats to the security of its populations and infrastructure. European governments, already under financial strain from ageing workforces and welfare systems, face ever more difficult choices about budget cuts in security and defence after the near-collapse of the global banking system. With the Lisbon Treaty in place and the European Union increasingly involved in international crisis management and stabilization operations in places near and far, this volume revisits the trajectory of a European strategic culture. Specifically, it studies the usefulness of its application in a variety of circumstances, including the EU’s operations in Africa and the Balkans as well as joint operations with NATO and the United Nations. The contributors find that strategic culture is a useful tool to explain and understand the EU's civilian and military operations, not in the sense of a ‘cause’, but as a European normative framework of preferences and constraints. Accordingly, classical notions of strategic culture in the field of international security must be adapted to highlight the specific character of Europe's strategic culture, especially by taking the interaction with the United Nations and NATO into account. Though at variance over the extent to which security and defence missions have demonstrated or promoted a shared strategic culture in Europe, the authors reveal a growing sense that a cohesive strategic culture is critical in the EU’s ambition of being a global actor. Should Europe fail to nurture a shared strategic culture, its actions will be based much more on flexibility than on cohesion. This book was published as a special issue of Contemporary Security Policy.
