Africa’s association with the European Union has long been hailed as a progressive model of North-South relations. European officials, in particular, have represented the Africa-EU ‘partnership’ as a pro-poor enterprise in which trade interests are married to development prerogatives. Applying a moral economy perspective, this book examines the tangible impact of Africa-Europe trade and development co-operation on citizens in developing countries. In so doing, it challenges liberal accounts of Europe’s normative power to enable benevolent change in the Global South and illuminates how EU discourse acts to legitimise unequal trade ties that have regressive consequences for ‘the poor’. Drawing upon the author’s own fieldwork, it assesses the difference between norms and the actual impact of EU concessions in relation to: budget support; aid for trade; private sector development (PSD); decent work. It concludes by considering the value of a moral economy approach in the assessment of free trade structures more widely. The ecosystem approach embodies a concept of the environment which emphasizes the integrated components of nature as complex adaptive systems. This book examines the relationship between the architecture and design of environmental law and the implementation of the ecosystem approach as a means to maintain ecological integrity. The main issue addressed is: in which manner and to what extent does fragmentation and administrative discretion in environmental law impede the implementation of an ecosystem approach? As part of the activities of the Legal Observatory Natura 2000, this book focuses on legal issues arising from the implementation by the national courts – constitutional, administrative and judicial ones – of the provisions relating to Natura 2000, in order to assess the contribution of the judge to the effectiveness of this regime. The enforcement of this legislation, which encompasses a complex body of technical rules, grounded on scientific concepts difficult to interpret for a non-scientist, is not easy to apply by a non-specialized judge.
