Its approach is multi-disciplinary, proposing transnational institutions for the management of transboundary resources. Benvenisti takes a fresh approach to the problem, considering mismanagement as the link between domestic and international processes. As well, he explores reasons why some collective efforts to develop the international law on transnational ecosystems have failed, while others succeeded. This inquiry suggests that adjudicators need to be assertive in progressively developing the law, while relying on scientific knowledge more than on past practice. Global water policy issues seem set to remain a cause for concern for the foreseeable future; this study provides a new approach to the problem of freshwater, and will interest international environmentalists and lawyers, and international relations scholars and practitioners.

This book has its genesis in a symposium of the International Water and Resource Economics Consortium held at Annapolis, Maryland, April 13-16, 1997. The symposium was organized by the editors and the book contains papers presented at the symposium with subsequent revisions. The symposium brought together both economists and agency management personnel for the purpose of discussing not only how economic tools apply to trans-boundary water management, but also of identifying the obstacles to making such tools useful and informative to politicians and negotiators in public decision making roles. INTERNATIONAL VERSUS DOMESTIC TRANS-BOUNDARY PROBLEMS Trans-boundary water problems arise in many dimensions. The two most important types of problems emphasized in this book are international and domestic interstate or interregional problems. Cooperation on international problems is especially difficult because enforcement must be voluntary given the sovereignty of nations and the absence of an effective legal enforcement mechanism. These shared rivers are the setting for irrigation, hydropower and flood management projects as well as water transfer schemes. Often, these projects attempt to engineer the river basin with deep political, socio-economic and environmental implications. Access to genetic resources and Benefit Sharing (ABS) has been promoted under the Convention on Biological Diversity, with the aim of combining biodiversity conservation goals with economic development. However, as this book shows, since its inception in 1992, implementation has encountered multiple challenges and obstacles. This is particularly so in the marine environment, where interest in genetic resources for pharmaceuticals and nutrients has increased. This is partly because of the lack of clarity of terminology, but also because of the terms of the comprehensive law of the sea (UNCLOS) and transboundary issues of delineating ownership of marine resources. The author explains and compares relevant provisions and concepts under ABS and the law of the sea taking access, benefit sharing, monitoring, compliance, and dispute settlement into consideration. He also provides an overview of the implementation status of ABS-relevant measures in user states and identifies successful ABS transactions. A key unique feature of the book is to illustrate how biological databases can serve as the central scientific infrastructure to implement the global multilateral benefit sharing mechanism, proposed by the Nagoya Protocol. The South China Sea disputes continue to confuse and confound policymakers. All the countries bordering directly on this sea - China, Vietnam, Taiwan, the Philippines, Malaysia, and Brunei - have claimed some or all of the tiny, but strategically located, Spratly Islets and some or all of the maritime space and its resources. All of these claims have serious weaknesses under the principles of international law that govern these issues. This book offers several possible regional interim solutions to the South China Sea disputes. All of the national claims to both islands and ocean space in the region have weaknesses. An interim solution is urgently needed because the status quo is dangerous and unstable, because of unilateral actions by the claimants and continuing opportunities for involvement by outside powers. Division or allocation of the features and ocean space among the competing claimants seem unfeasible because of their sharp disagreements over the boundaries of the area in dispute as well as what would constitute an appropriate equitable division. The authors survey the principles that appear to guide the nations of the South China Sea region in their regional relations, and they identify the appropriate objectives of a regional resource authority. They also identify the political realities of the region, which serve as constraints on the design of a regime. The authors propose the creation of a regional multilateral resource management body as a solution to reduce the tension currently rife in the region. The options presented serve as illustrations designed to stimulate constructive discussion on a comprehensive multilateral interim solution to these difficult and dangerous disputes. Sharing the Resources of the South China Sea will be of interest to international decision-makers, negotiators, and academics desirous of a peaceful solution to these disputes.
