If all the people, municipalities, agencies, businesses, power plants, and other entities that think they have a right to the water in Texas actually tried to exercise those rights, there would not be enough water to satisfy all claims, no matter how legitimate. In Sharing the Common Pool: Water Rights in the Everyday Lives of Texans, water rights expert Charles Porter explains in the simplest possible terms who has rights to the water in Texas, who determines who has those rights, and who benefits or suffers because of it. The origins of Texas water law, which contains elements of the state’s Spanish, English, and Republic heritages, contributed to the development of a system that defines water by where it sits, flows, or falls and assigns its ownership accordingly. The Convention on Biological Diversity (CBD) strives for the sustainable and equitable utilization of genetic resources, with the ultimate goal of conserving biodiversity. The CBD and the Nagoya Protocol which has since been elaborated suggest a bilateral model for access to genetic resources and the sharing of benefits from their utilization. There is concern that the bilateral exchange "genetic resource for benefit sharing" could have disappointing results because providers are left out of the process of research and development, benefits are difficult to be traced to sources, and providers owning the same resource may complain of being excluded from benefit sharing. Thus, the CBD objective of full utilization and equitability may become flawed. Common Pools of Genetic Resources: Equity and Innovation in International Biodiversity Law suggests common pools as a complementary approach to bilateralism. This is one of the first books to reply to a number of complex legal questions related to the interpretation and implementation of the Nagoya Protocol. Taking an inductive approach, it describes existing pools and analyzes how they are organized and how they perform in terms of joint R&D and benefit sharing. It presents case studies of the most characteristic types of common pools, provides suggestions for further developing existing pools to cope with the requirements of the CBD and NP and, at the same time uses the clauses these conventions contain to open up for commons approaches. Why do states often fail to cooperate, using transboundary natural resources inefficiently and unsustainably? This book, first published in 2002, examines the contemporary international norms and policy recommendations that could provide incentives for states to cooperate. Its approach is multi-disciplinary, proposing transnational institutions for the management of transboundary resources. Benvenisti takes a fresh approach to the problem, considering mismanagement as the link between domestic and international processes. As well, he explores reasons why some collective efforts to develop the international law on transnational ecosystems have failed, while others succeeded. This inquiry suggests that adjudicators need to be assertive in progressively developing the law, while relying on scientific knowledge more than on past practice. Sustaining our agricultural landscapes is no longer just a technical, scientific or even political problem, but it has evolved into a socially complex, so-called wicked problem of conflicting social governance and economics. This creates an extreme economic obstacle where the value of ecosystem services remains low and diffuse and the transactions costs remain high and multiple.Using Uber-like business platform technology and a shared governance model, a symbiotic demand for environmental benefits is created. Enabling multi-sector transactions for environmental benefits, this platform innovation would remedy the "tragedy of the commons"; the economic nemesis to achieving landscape sustainability. In a nutshell, to sustain our agricultural landscapes a transdisciplinary approach supported by a shared governance model housed within a multi-sided platform in needed. This book introduces an assessment framework identifying governance actors, styles and ratios for socio-ecological systems. The assessment uses a new governance compass to identify the types of actors completing which tasks and identifies the styles of governance used to complete the tasks. It is aimed to anyone involved in sustainability science, agricultural policy planning, or integrated landscape design.
