This book will allow the self-represented litigant to handle his or her divorce like an experienced professional. This text is directed at three primary audiences. First, it is meant for the person who has already decided to self-represent, regardless of the reasons or personal circumstances, and is seeking a comprehensive resource to assist in the process. When it comes to divorce, lawyers have an indisputable and unconscionable conflict of interest. They have a perverse incentive to ensure that the divorce process is as contentious as possible, to make it last longer than is strictly necessary, to take cases to trial needlessly and to work in collusion with opposing lawyers against their clients' interests, all to maximize legal fees. Much thought and attention has been dedicated to organizing the information in this book so that it is easy to access and consume on an as-needed basis. Divorces unfold in distinct phases over time, so information does not have to be consumed all at once. There will be ample time to learn what is needed over the course of the proceedings. Special attention is paid to the preparation of the pro se litigant for trial. Although only five percent of all divorce cases go to trial, self-represented litigants must have the knowledge and skills necessary to take their cases to trial or the mere threat of a trial by the opposing party will induce them to accept egregious settlements. It is, after all, only the weighing of the respective cases, in the context of a possible trial, that allows the parties to settle without a trial - a paradox of sorts. The author, Victor Prince, holds a master's degree in engineering from Cornell University and an MBA from Stanford University. His training as an engineer helped him to approach the topic with the rigor and thoroughness of a scientist in order to understand and decipher the process, and he relied on his business background to translate the lessons that he learned as a pro se litigant into a book that allows readers with no legal training to represent themselves in divorce cases. This Handbook is designed to help people dealing with civil lawsuits in federal court without legal representation. Proceeding without a lawyer is called proceeding "pro se1," a Latin phrase meaning "for oneself," or sometimes "in propria persona," meaning "in his or her own person." Representing yourself in a lawsuit can be complicated, time consuming, and costly. Failing to follow court procedures can mean losing your case. For these reasons, you are urged to work with a lawyer if possible. Chapter 2 gives suggestions on finding a lawyer. Do not rely entirely on this Handbook. This Handbook provides a summary of civil lawsuit procedures, but it may not cover all procedures that may apply in your case. It also does not teach you about the laws that will control your case. Make sure you read the applicable federal and local court rules and do your own research at a law library or online to understand your case. The United States District Court for the Northern District of California has Clerk's Offices in the San Francisco, San Jose and Oakland courthouses. Clerk's Office staff can answer general questions, but they cannot give you any legal advice. For example, they cannot help you decide what to do in your lawsuit, tell you what the law means, or even advise you when documents are due. There are Legal Help Centers in the San Francisco, Oakland and San Jose courthouses where you can get free help with your lawsuit from an attorney who can help you prepare documents and give limited legal advice.
