Causation and Responsibility
Author: Michael S. Moore
Publisher: Oxford University Press
ISBN: 0199599513
Category : Law
Languages : en
Pages : 635
Book Description
The concept of causation is fundamental to ascribing moral and legal responsibility for events. Yet the relationship between causation and responsibility remains unclear. What precisely is the connection between the concept of causation used in attributing responsibility and the accounts of causal relations offered in the philosophy of science and metaphysics? How much of what we call causal responsibility is in truth defined by non-causal factors? This book argues that much of thelegal doctrine on these questions is confused and incoherent, and offers the first comprehensive attempt since Hart and Honoré to clarify the philosophical background to the legal and moral debates. The book first sets out the place of causation in criminal and tort law and outlines the metaphysics presupposed by the legal doctrine. It then analyses the best theoretical accounts of causation in the philosophy of science and metaphysics, and using these accounts criticises many of the core legal concepts surrounding causation - such as intervening causation, forseeability of harm and complicity. It considers and rejects the radical proposals to eliminate the notion of causation from law byusing risk analysis to attribute responsibility. The result of the analysis is a powerful argument for revising our understanding of the role played by causation in the attribution of legal and moral responsibility.

Causation, Prediction, and Search
Author: Peter Spirtes
Publisher: Springer Science & Business Media
ISBN: 1461227488
Category : Mathematics
Languages : en
Pages : 551
Book Description
This book is intended for anyone, regardless of discipline, who is interested in the use of statistical methods to help obtain scientific explanations or to predict the outcomes of actions, experiments or policies. Much of G. Udny Yule's work illustrates a vision of statistics whose goal is to investigate when and how causal influences may be reliably inferred, and their comparative strengths estimated, from statistical samples. Yule's enterprise has been largely replaced by Ronald Fisher's conception, in which there is a fundamental cleavage between experimental and non experimental inquiry, and statistics is largely unable to aid in causal inference without randomized experimental trials. Every now and then members of the statistical community express misgivings about this turn of events, and, in our view, rightly so. Our work represents a return to something like Yule's conception of the enterprise of theoretical statistics and its potential practical benefits. If intellectual history in the 20th century had gone otherwise, there might have been a discipline to which our work belongs. As it happens, there is not. We develop material that belongs to statistics, to computer science, and to philosophy; the combination may not be entirely satisfactory for specialists in any of these subjects. We hope it is nonetheless satisfactory for its purpose.

The Application of the Doctrine of a Loss of a Chance to Recover in Medical Law
Author: Pat Van den Heever
Publisher: PULP
ISBN: 0980265843
Category : Law in general. Comparative and uniform law. Jurisprudence
Languages : en
Pages : 92
Book Description
About the publication In this book, Pat van den Heever assesses the application of the doctrine of a loss of a chance in medical negligence cases in South Africa. He emphasises the difficulties often encountered by courts when adjudicating on causation in medical negligence cases in the face of multiple causation theories. On the basis of a thorough review of the position regarding the doctrine of a loss of a chance in The United States of America, Australia and Britain, he proposes for South Africa a de lege ferenda loss of chance model for application in medical negligence matters. As the first ever major work dealing with the application of the doctrine of a loss of a chance in medical negligence matters in South Africa, this book is of interest to the courts and the legal profession generally, legal academics working in the field of medical law and the law of delict, health care providers, and members of the medical and allied professions, their councils, associations and protection societies. "This publication is the first authoritative and substantive research on the doctrine of a loss of a chance in the context of medical negligence in South African medical law ... Dr van den Heever's thorough and comprehensive comparative approach and discussion of the doctrine here, is commendable ... [T]his publication is indeed timely!" - Pieter Carstens, Professor of Medical Law, University of Pretoria.

Practical Psychiatric Epidemiology
Author: Jayati Das-Munshi
Publisher: Oxford University Press
ISBN: 0191054461
Category : Medical
Languages : en
Pages : 508
Book Description
Epidemiology has been defined as the study of the distribution and determinants of health states or events in defined populations and its application to the control of health problems. Psychiatric epidemiology has continued to develop and apply these core principles in relation to mental health and mental disorders. This long-awaited second edition of Practical Psychiatric Epidemiology covers all of the considerable new developments in psychiatric epidemiology that have occurred since the first edition was published. It includes new content on key topics such as life course epidemiology, gene/environment interactions, bioethics, patient and public involvement in research, mixed methods research, new statistical methods, case registers, policy, and implementation. Looking to the future of this rapidly evolving scientific discipline and how it will to respond to the emerging opportunities and challenges posed by 'big data', new technologies, open science and globalisation, this new edition will continue to serve as an invaluable reference for clinicians in practice and in training. It will also be of interest to researchers in mental health and people studying or teaching psychiatric epidemiology at undergraduate or postgraduate level.
